HomeMy WebLinkAbout1668ORDINANCE NO. 1668 AN ORDINANCE AMENDING SUB-SECTIONS (G) AND (H) OF SECTION 40 OF ORDINANCE NO. 763 OF THE CITY OF SAN BERNARDINO. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BER- NARDINO DO ORDAIN AS FOLLOWS: SECTION ONE: That Sub-section (g) of Seotion 40 of Ordinanoe No. 76) is hereby amended to read as follows: "(g). Each person, firm, oorporation or association of persons operating, conduoting and oarrying on any public danoe hall, danoing olub, dine and dance olub or night club, under the provisions of this ordinance shall employ, at his or its own ex- pense, a man to be known and designated as a "Special Polioe Of- ficer", to be in attendance at any and all times that dancing is allowed, permitted or conducted at the plaoe for which the lioense is issued. That said "Special Police Officer" shall keep the peac at such dances, and shall at all times enforoe all laws applicable thereto, and shall upon request of the Chief of Police at the City of San Bernardino make a written report to said Chief respeoting the operation, conduct and management ot said business. The ap- pointment of the "Special Polioe Officer" reterred to shall be sub ject to the approval of the Chief of Police of said City of San Bernardino, and if approved by him the person so selected shall be deputized as a "Speoial Police Officer" of said oity. The offioer so approved and deputized may be removed at said Chiet's pleasure. He shall be paid :he sum of .4.00 per day by the person, firm, corporation or association of persons operating, conducting or carrying on any publio danoe hall, dancing club, dine anddanoe club or night club requiring his attendance. Every person, firm, corporation or association of persons operating, oonduoting or carrying on any public dance club, danoinb club, dine and dance club or night olub shall seleot and deSignate 6 7 8 1 2 :5 4 5 e 7 8 9 10 II 12 13 14 15 Ie 17 18 19 20 21 22 2:5 24 25 26 27 28 29 30 31 32 a woman to be known as a "Matron". The person so selected and designated shall, be subject to the approval of the Chief of Police It shall be the duty at said "Matron" to generally assist the "Special Police Officer" in the pertormanoe at his duties, and to report to him any and all violations of laws that she may observe, and any and all aots or conduct that occur that are oontrary to public health, peaoe or morals. In any oase where the Chief of Police of the City of San Bernardino shall find that preservation of public peace, health or morals does not require the attendance ot a "Speoial Polioe Of- fioer" and/or "Matron" in any dine and dance club or night club, as tbe same is defined in this ordinanoe, where no alcoholic beverages are sold or permitted or allowed to be consumed on the premises, he is, in the exercise at his discretion, authorized to waive the requirement for the attendanoe at a "Special Police Of- ficer" and/or "Matron"; provided, that at any time after such a waiver has been made the Chief at Polioe shall determine that the publio peace, health or morals require the attendanoe ot a "Speoial Polioe Offioer" and/or "Matron" he shall so notify suoh licensee of suoh plaoe of business in writing and thereafter a "Speoial Police Offioer" and/or "Matron" shall be required to be in attendance in accordance with the provisions at this ordinance; and, provided further, that in no case where such a plaoe of business either sells, or permits or allows the oonsumption of, alooholic beverages on the premises, shall or is the Chief ot Polioe authorized to waive the provisions at this ordinanoe re- quiring the attendance ot a "Special Police Officer" and "Matron". S~CTION TWO: That Sub-seotion (h) of Seotion 40 ot Ordinanoe No. 763 is hereby amended to read as tallows: "(h). It shall be unlawful for any person, oorporation or assooiation of persons to operate, conduot or carryon a publio dance, public dance hall, dancins olub, dine and dance olub, or " -2- 7 8 9 IO 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 28 27 28 29 30 :51 32 1 night club, between the hours of two o'olock A. M. and eight 2 :5 o'clook A. M., of anyone day,provided, however, that the restriotion herein imposed applies only to the permitting or allowing the public to dance between suoh hours and is not deemed to prevent or make unlawful the serving at meals or refreshments 4 5 6 between suoh hours." SECTION THREE: This Ordinanoe shall be in force and take effeot tram and after thirty days after its passage and approval. SECTION FOUR: The City Clerk shall certify to the pas- sage ot this Ordinanoe and shall cause the same to be published three consecutive times in the Ban Bernardino Daily Sun, a daily newspaper hereby designated for that purpose.
