ORDINANCE NO. 1674
AN ORDINANCE AMENDING ORDINANCE NO. 1666 ENTITLED
"AN ORDINANCE REGULATING AND LICENSING THE OPERATION OF MOTOR
BUSES TRANSPORTING PASSENGERS FOR HIRE WITHIN THE CITY OF SAN
BERNARDINO, AND FIXING THE PENALTY FOR ITS VIOLATION".
THE MAYOR AND COM/iON COUNCIL OF THE CITY OF SAN
BERNARDINO DO ORDAIN AS FOLLOWS:
Seotion 1: That Seotion 30 of Ordinanoe No.l666 is
hereby amended to read as tallows, to-wit:
"Seotion 30: BOND.
The Licensee hereof' wi thin ten (lO) I

oedent to the exeroise of any of the rignts herein granted, shall
make, execute and deliver unto the City, and shall, at all times
during the life at this permit, maintain in full foroe and etfeot,
a good and sufficient bond, or good and sufficient bonds, issued
by a corporate surety authorized by law to engage in the surety
business in the State of Calitornia, in the prinoiple sum, or the
aggregate prinoipal sums, as the oase may be, of Two Thousand Dol-
lars ($2,000.00). Said bond or bonds shall, before beooming ef-
teotive, be approved as to the surety and as to the sufficienoy
thereot by the Mayor and Common Co~oil ot the City of San Bernar-
dino, and as to fODn by the City Attorney of the City of' San Ber-
nardino. The aforesaid bond or bonds shall be oonditioned that
Lioensee shall well and truly observe and faithfully perform each
and every term, oovenant and condition oontained in this permit,
which are to be kept and perfoDned by the Licensee, and that in th
evao.t a breach is IIBde in such oonditions ot the permit, then and
in that event, the Whole amount of the penal sum therein named, or
the aggregate of the penal sums of all like bonds, as the oase may
be, shall be forteited to the City.
Suoh bond, or bonds, may be so written as to provide
38 that the surety or sureties thereon may cancel the same by giving

1 at least sixty (60) days' notice, in wri ting, to the City of e'an
2 Bernardino of their intention so to do; cJnd upon the termination
3 of such bond, ot' bonds, by such notice together "lith the execu-
4 tion and delivery to the City by the Licensee of another bond, 0
5 other bonds, in like principal amounts, in the place and stead 0
6 those c'iIlcelled, and likewise satisfactory to and ap"Jroved by
7 officers of City as aforesaid, such sureties on such cancelled
8 or terminated bond, or bonds, she~l be relieved from all liabil-
9 ity incurred by acts, breaches or defaults of the Licensee occur
10 ring subseQuent to the effective date of such new bond or bonds.
11 The continuance in effect of the afores'lid bond, or
12 bonds, shall be a condition precedent to Licensee's right to
13 continue to exercise any or all of the rights or privileges
14 hereby granted, but in the event of the cancellation of any such
15 bond, for eny reason, and in the eV$nt of the inability of the
Licensee to secure a satisfactory surety bond)rior to the actual

dateiof the termination or liability under any such bond then in

force herelli"der, tllen and in that event Licensee may satisfy the
provisions of this section by depositing VQth the City Treasurer
of the City of San Bel~ardino, United States Government Bonds,
the face value of v~ich shall equal, or be in excess of the sum
of Tvro Thousand Dollars ($2,000.00), or in lieu thereof, Licensee
may deposit with the City 'freasurer the sum of Two Thousand Dol-
lars (~2,000.00), law'ful money of the United States of ALlerica,
whbh bonds, or lavrrul money, may like~ise be vQthdrawn upon at
least sixty (60) days' notice to City, in writing, of Licensee's
intention so to do and upon deposit ,d,thin sfiid sixty (60) day
period of a surety bond, or bonds, satisfactory to City as here-
inabove in this Section 30 provided.
That said Licensee may cancel said permit and cease
operating said motor busses by giving ninety days' written notice
so to do, to sai d City of Sac, Bernardino, Bnd in that event said

1 bond or bonds or money shall be cancelled or withdrawn 'J.pon the
2 expiration of said period; provided said Licensee has fully end
3 faithfully performed all the terms and conditions of said per-
4 mit, otherwise said bond or bonds or money shall remain in full

Section 2. This ordinance shall be in force and take
7 effect from and after thirty (30) days after its passage and
e approval.

Section J: The City Clerk Shall certify to the passage
10 of this Ordinance, and shall cause the same to be published
11 three consecutive times in the San Bernardino DaHy bun, a daily
12 newspaper thereby designated for that purpose.
13 I HEREBY CEHTIFY that the whole number of members of
14 the Common Council of the City of San Bernardino is five, and
15 that the foregoing Ordinance was adopted by the Common COlliLcil
16 at a regular meeting thereof held on the ~~ day of ~___
