HomeMy WebLinkAbout1359 1 ORDINAllCE NO. / p?jl 2 AN ORDINANCE OF THE MAYOR AND COMMON COUNG IL OF THE 3 C!tV OF SAU BERNARDINO, AMENDING ORDINANCE NO. 821, E!1TITLED "AN ORDINANCE REVISING AND CODIFYING THE ORDINA1TCES OF, AND 4 PROVIDING A CODE OF I,AWS FOR THE CITY OF SAN BEIDIARDINO" , PASSED AUGUST 8, 1921, .AND APPROVED AUGUST 9, 1921. 5 6 The Mayor an.d Cormnon Counci1 of the City of San Ber- 7 nardino do ordain as follows: 8 SECTION ONE: That Ordinance No. 821, entitled "An 9 Ordinance revising and codifying the Ordinances of, and pro- 10 viding a code of laws for the city of San Bernardino", -passed 12 August 8, 1921, and approved August 9, 1921, be and the same is hereby amended by adding ~J~~ new sections thereto, to be designated and to read as foJlows: 11 13 14 15 .CHAPTER VII--BUILDINGS SIGnS. 16 Section 790. (a) The word "sign", as used through- 17 out in this Section, shall be deemed to mean ~1Y sign, sign 18 board, or sign device of any character, (other than a bill 19 board), atta.ched or hung in any manner or placed in front ofl 20 upon, or adjacent to any building, or placed or maintained on 21 or above any sidewalk, street, or public property. 22 (b) It shall be unlawful for any person, firm or 23 corporation to erect, place, suspend, attach, or maintain any 24 sign in violation of any of the provisions of this Section. 25 The Building Inspector is hereby named as the proper official 26 to enforce all the provisions and requirements of this 8eo- 27 tion, exoepting those provisions relating to the electrioal 28 work, including wiring, lamps and conduits, Which shall be en- 29 forced by the Ci ty Electr ic ian. The looation of any sign, 30 its fastenings, and the safety of the wall, roof or supports 31 supporting the same, shall be approved by the Building In- 32 spector before the work or sign is started. No sign or banner -1- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 28 27 28 29 30 31 32 shall be fastened to or supported by any fire escape or stand pipe. (c) Except as otherwise ~articularly stated herein, no sign shall be erected, placed, hung or rehung without first obtaining a written p~rmit from the Building Inspector. The f€'e for such permi t shall be based at the sa.me rate as re- quired for construction of buildings. All electric signs will require two permits, one to be issued by the Building Inspector and one to be issued by the City Electrician. Before any per- mit is issued for a sign, a sketch showing the weight, sha.pe, size and construction shall first be submitted to the Building Inspector, and in the case of an electric sign, a. similar sketch shall be submi t ted to the City Electr ic ian. The following signs do not require permits: Signs, other than roof, pent house and electric signs, which do not project more than six inches beyond the face of the building and are less than twenty square feet in ~~ ea. (d) The minimum diameter of any supporting wires or cables shall not be 1e36 than 3/15 inch galva.nized wire or cable for signs projecting less tha.n five feet, and the mini- mum diameter of such supporting wires or cables shall be not less than 1/4 inch galvanized wire or cable when the sign pro- jects five feet or more. All guy wires shall be at least 3/16 inch galvanized wire or cable. All guy and supporting wires or cables shall be provided with galvanized turnbuckles. All other supports, bra.ckets, screW eyes, strap irons, etc .', shall be ga.lvanized or pa.inted with two heavy coats of protective non-corrosive paint. Dislodged or loose brick, stone, or masonry around fastenings must be permanent- ly cemented back in place. All expansion bolts must be in solid masonry. ( e) All signs and supports l1lust be kept in good repair and working order by the person, firm or corporation owning, operating or having the care or custody of such signs. The Building Inspector shall, in the event of a violation of or failure to comply with any of the provisions of this Sec- tion, have the power to order and compel such sign to be taken down and removed within ten days from the date of such order. (f) No sign, whether temporary or permanent, shall be placed or hung in such a way as to project in front of, or obstruct the view of any window. Signs projecting more than six inches away from face of building or over public property, must be hung at right angles to face of building or property line, except at corner of two intersecting streets, in which case, the sign shall be hung so as to make the same angle with both streetso No sign shall project more than ten feet from the face of a.ny building. "V" ahaped signs projecting more than thirty inches beyond the property line are prohibited. No sign (except cloth or fabric banner) shall be suspended over the ro adway 0 f any pub 1 io s tr eet or alley. (g) All signs Which project or extend over the walk or other public property more than tm~ee feet shall be hung by a hinged connection at building in such a manner that the said sign may be easily swung back against the building, or other supports, in the absence of a building. The hinge connection or hinge proper must be within twelve inches of the property line. All signs must be fastened with permanent side guy wires. (h) Except as otherwise noted below, all signs with- in the Fire Limite, any part of which projects more than six inches beyond the face or wall of a building, or projects more than six inches over public property, shall be constructed of metal. This also applies to signs proj ecting six inches or less, when the area of such signs are twenty square feet, or more, in superfic ial area. Any sign, projecting more than tl:rree feet beyond the property, regardless of location, must be an electric sign. All metal signs other than electric, may have small wood mould- ing or frame around the outer edge. (i) Canva.s and similar approved banners stre tched across streets or other public property will be permitted upon a permit obtained from the Mayor and Common Council of the City of San Bernardino, paying the latter a fee of $1.00 for permits, before erecting the banner. At least one one-inch sound rope shall be used for main banner support, and two 1/2-inch auxil- iary ropes, one for each lower corner of the banner. Temporary fabric or cloth signs tightly stretched on a. wood frame and placed flat against &. bUilding will be per- mittedo No temporary sign shall extend more than six inches over public property. All fabric or cloth signs must be perma- nen tly removed \vi thin thirty days after being erected, or new permit requiredo (j ) No sign shall be suspended from or below another, or supported on top or above another sign, unless the total height of all signs taken together, measuring from extreme bot- tom edge to extreme top edge, sha11 come within all the provi... aions of this Ordinance regulating the height of a single sign. When the bottom of a sign is more tl.l.an ten feet a.nd leds thf;.i.n twelve feet above the sidewa.lk grade, the proj ection over the sidewalk shall not exceed three feet. When the bottom of a sign is twelve feet or more above the sidewalk, the proj ection over the sidewalk may extend a distance equal to three-fourths of the width of the sidewalk in front of the building from which such sign is hung, measured at right an gl es to the build ing. Ho sign shall oe more than ten feet in length. l~o sign shall exceed four feet four inches in height, measured from the top to the bottom, when projecting more than three feet beyond the face of the building, excepting that electric signs which do not project more than four feet from the property line may extend full height 0 f building. No hanging sign can hang more than four feet above parapet wall. (k) Roof signs exceeding a total height of twenty feet, advertising surface, shall be of metal open work skeleton lettered construction with a structural steel frame. Signs on roofs of buildings shall not exceed a to tal height of thirty fee t. No roof sign shall be placed nearer than three feet to any parapet wall. The lower edge of all roof signs must be kept at least four,feet above that part of the roof upon which the sign rests. The above three foot and four foot clearances must be kept clear of all obstructions excepting the main sup- port of the sign; excepting that signs not exceeding two feet in total height may be placed directly on the ridge and para- llel to the same. All roof and pent house signa and sign sup- ports, braces and fastenings must be of non-combustible ma- terials. Pent house signs shall not exceed a total height of twenty feet, measured from the roof of the main building above which the pent house projects, unless the pent house sign meets -5- 1 all the requirements of roof signs above mentioned. Roof 2 signs shall not have a greater width than the roof upon Which 3 the said sign stands. Signs may project three feet beyond 4 each side of pent house. 5 All signs, regardless of locations, shall have suf- 6 fie ient streng'th to safely withsta.nd. lateral wind pressure of 7 twenty pounds per square foot of exposed surface. The strength 8 of all roofs must be investigated and. approved by the Building 9 Inspector before a permit for a roof sign can be issued. 10 ELECTRIC SIGN DEFINED. 11 (1) A sign with its entire lighting system directly 12 electrically lighted by electric wiring and lights installed 13 therein and lighted therefrom, and no t illumina ted by reflect- 14 ed light. 15 All signa using luminous gases operated by high po- 16 tential currents shall take a permit fee of one cent per watt, 17 with a minimum charge of $1.00. 18 Illumination of any sign by reflected light shall 19 not qualify such sign as an electric sign in the intent of this 20 Ordinance, nor shall any lights or lamps be held away from the 21 sign, with arm brackets, conduits or rods. 22 (m) Wires carried on the outside of signs must be 23 run in metal conduit, or lead sheathed armored cable. Wires 24 within the sign structure must be double braided, rubber cov- 25 ered, and may be carried not less than 1/2 inch in the clear 26 of each 0 ther or surrounding me tal. Where such spac ing must 27 be less than 1/2 inch, the wires must be in conduit or cabled. 28 All electric signs shall be constructed entirely of 29 metal or other approved non-combustible material. The sheet 30 metal must not be leas than 26 u. S. standard gauge. All elec- 31 1r ic signs shall be braced by angle iron and metal braces of 32 such thickness and size and in such position as to insure suf- -6- 1 ficient strength and rigidity with the proper factor of safety. 2 Plain glass panels or characters more than 150 square inches 3 in area on any sign are prohibited, unless wire glass is used. 4 The bottom of all hollow or box electric signs shall have at 5 least one drainage hole; the diameter of such drainage hole 6 sha.ll be at least 1/4 inch for each square foot of sign sur- 7 fa.ce. No sign other than an electric sign shall be superim- 8 posed or suspended on or from another electric sign. 9 (n) In the case of ornamental scroll work or simi- 10 l8,r embellishments on electric signs, when impractical to 11 support wires as above stipulated, the wires may be separated 12 from the metal by sections of porcelain or glass not less than 13 1/8 inch in thickness. When wires cross each other, pass out 14 of letters, or into cut-out boxes. they must be protected by 15 a.pproved tubes or bushings. When wires not inferior in size 16 and insulation to approved No. 14 B & S gauge are used to con- 17 neat direct to standard sockets or receptacles totaling not 18 over 1320 watts at 110 volts or equivalent, 6~ae shall be de- 19 nendent upon final cut-ou t. 20 (0) All electric signs must be burned at least two 21 hours each and every night, excepting Sunday nights, between 22 one-half hour after sunset and ten o'clock P. M. All signs 23 not so bu~ned shall be removed upon order of Police Depart- 24 mente All signs shall conform to the state Safety OrderB~ 25 and the illumination of same shall be calculated for not less 26 than 8 C. P. of light to the square foot. 27 (p) The fee for electric inspection and permit shall 28 be as follows: 29 30 Electr ic Signs containing 1 to 10 lights...... $1. 00 Electric Signs conts.ining 11 to 25 lights..ltd. 2.00 Electric Signs containing 26 to 50 lightse.... 2.50 Electric Signs containing 51 or more lights~.. 3000". 31 32 -7- 1 "RADIO TOWERS, me. Section 791. (a) Radio towers or masts, placed on 2 3 buildings, and whe n no t of struc tural steel and self- support ing, 4 sha.ll have guy wires a.t lea~t 1/8 inch in diameter when the 5 mast does no t exc eed twenty feet in height, and no t less than 6 3/16 inch in diame ter when exc eeding twenty feet in he ight; 7 guy wires each to be provided with galvanized iron turn buckle. 8 Provide three or more guys at each connection or staying point 9 of the mast. Guy connections at mast shall not be more than 10 twelve feet apart, measured vertically. 11 All wo Qien radio towers or masts in the fire limi ts 12 must be treated with fire resisting paint or constructed of 13 fire resisting material. 14 (b) Masts, when of wood, must have an average cross 15 sec tiona,l area of nine or more square inches when no t more than 16 twenty feet in height, and at least fourteen or more square 17 inches when exceeding twenty feet in height. Height of wood 18 ma.sts, when placed on buildings, must not exceed thirty-eight 1.9 feet. Wood masts must be sound straight gra.ined timber, free 20 from kno ts or other detrimental defects. 21 (c) Before erecting radio masts or towers, a permit 22 must first be obtained in all cases, except that radio masts 23 not exceeding twenty feet in height and when located outside 24 the Fire Limi ta, will require no permit. For the purpose of this Ordinance, the 3 term "b illboard" ahall mean any structure erected for the pur- 4 pose of exhibiting advertising and having an area of face A~"- '-.,I'..t\.. 5 ceeding forty square feet. No portion of any billboard or the a lighting system or other attachments shall encroach upon a pub- 7 lic street, alley or park way. 8 The ba.se of a billboard shall not be less than 9 eighteen inches or more than five feet above the leval of the 10 ground. The space below the billboard may have a lattice work 11 constructed therein of such a design as not to materially ob- 12 struct the view under said billboard. The advertis ing surface shall not exceed twelve feet in vertica.l dimension. Billboard 13 14 structure shall be designed to withstand a wind pressure of 15 twenty pounds per square foot. Billboards erected with~the Fire Limits shall be.of 18 17 metal on a frame wi th metal or fire resis ting supports. '''ooden 18 ornamental moulding not exceeding one foot in width may be 19 placed around the advertising surface and ornamental posts may 20 be placed where desired, but shall not extenG more than four 21 feet above the advertising surface. All wood work shall be 22 painted wi th a. fire resistan t pain t or some fire res is ting ma- 23 terial. 24 PERMITS FOR SIGN AND BILLBOARDS: No sign or billboard 25 allowed under the provisions 0 f this Ordlnance, except as 0 ther- 26 wise provided, shall be erected within the Fire Limits without 27 first obta.ining a building permit therefor. Any electrical 28 construction appurtenant to said signs or billboards, shall be 29 done only under the provisions of law covering said work, and 30 a permit shall be obtained therefor. Cost of permit shall be 31 the same as for electric signa.
