C- 2 AN ORDINANCE OF THE JiA,YOR A..1\fD cOMrvroN COUNt; IL OF THE 3 CI'l'Y OF SAN BJl";RNARDINO, APPROVING THE AUNEXATION OF THE MOUN'- l' AI N DISTRICT Al 4 5 \VHEREAS, heretofore, on the I if day of//1;v~;mjf~ 6 1926, a petition wa,s filed with the Mayor and Common Council 7 of the City of San Bernardino, a8king that tile territory here- 8 inafter described be annexed to the City of San Bernardino; 9 and 10 WHEREAS, sc:...id petition described said territory pro- 11 posed to be annexed to said City of San Be:rl1&.rdino; and 12 WHEREAS, said petition was signed by not less than 13 ol.1e- fourth in numb er of the qualified electors ::-es id ing in 14 sa.id territory herein mentioned, as shown by the registration 15 of V0 tel'S 0 f the County 0 f San Bernardino, being the County in 16 which said territory is situated; and 17 WHEREAS, Said territory is contiguous to the City of 18 San Berna.rd ino; and 19 WIIEREAS, therea.fter, the Mayor and Common C ounc iJ 0 f 20 the City of San Bernardino did, by Ordinance, call a special 21 election and submit to the electors residing in o~id territory 22 proposed by such petition to be annexed to the said City of 23 San Bernardino, the question whether such territory shall be 24 annexed to, incorporated in, and made a part of such municipal 25 corporation; that said legislative body caused notice to be 26 given of sach election by the ~~)ublication of 54. notice thereof 27 in a. newspaper of general C ircuJation, nri.n ted and published 28 in ti:e City of San Bernard ino, for ten consecutive days before 29 the date of such elec tion; and 30 WHEREAS, said Ordinance was duly :0ubl ished in the :31 (!g!t~ l?4/1)( lAu {le r , a newspaper pr in ted and pub lished 32 outside of such municipaJ corporation but in the County in -1- 1 2 3 4 5 a 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 which the territory so proposed to be annexed is situated, at least once a week for a period of four successive weeks next preceding the date of said election; and W}ThffiEAS, such legislative body caused notice of such election to be given by the posting thereof in three public places within the territory so proposed to be annexed, at least four weeks preceding the date of said election; and WHEREAS, such notice did <distinctly state the date of such election, the proposition to be submitted: that it is proposed to annex to, incorporate in, and make a part of such municipal corporation, the territory sought to be annexed, spec ifically descr ib ing tile bou ndar ies thereof; and 'WHEREAS, in addition to such description, such ter- ritory was also designated in said notice as "Mountain Distric1!t, the same being an anpropriate name or words of identification by wbich said territory was referred to and indicated u-pon tbe ballots used at said election at which the question of such annexation wa.s submitted; a.nd W}J!JREAS, the elec tors of such terr i tory were d irec t- ed by such notice to vote Uyon such question; and WHEREAS, the Mayor and Common Coune i.I in said Ordi- nance calling said election, did appoint officers for such election, consisting of two jUG.ges and one inspector, each of whom was a qualified elector of the voting precinct in which he Was appointed to act as an officer of such election, and did designate the "OolJ.ir:!g place for said election; and WHEREAS, the said Malor and Commo n Coune i1 did cause to be furnished for use at said election, ballots containing the nronosition to be voted on, and directed that if an elector shall stamp a cross (x) in the voting square after the printed word uYes", the vote of such elector shall be counted in fairor of the annexation of the territory, referred to in the notice, -2- 1 to the city of San Bernardino, and if such elector shall stamp 2 a cross (x) in the voting square after the printed word "noff, 3 the vote .of such elector shall be counted agains t such annexa.- 4 tion; and 5 WHEREAS, the calla ts used at such election, the 6 open ing and clos ing 0 f the polls, and the holding and conduc t- 7 ing of such election was in conformity, as near as may be, 8 with the la,\'lTs of the state of California concerning general 9 elec tions, except as 0 therwise provided by law; and WI-IEP..EAS, the judges and inspec tor 0 f said elec tion, 10 11 immed iately on the closing of the polls, counted the ballo ts, 12 made up and c er tif ied and sealed the taJ lots and taJ ly shee ts 13 of the ballots cas t at their respective polling places, in 14 the manner nrovided by law, and did thereupon deliver the 15 ballots, tally sheets and returns to and deposited tile SaIne 16 with the City Clerk of the City of San Bernardino; and 17 WHEREAS, the said Mayor and Common C ounc il did, on 18 the second day after sa.id election, exclusive of hOlidays, the 19 said day be ing also the first regular meeting day of said 20 Mayor and Cormnon Council after the holding of said election on 21 said 10th day of December} 1926, meet and proceed to canvass 22 said returns and complete such canvass, and did, i.rn.'11edictely 23 upon the com-pletion of such canvass, cause a record thereof to 24 be made and entered upon its minutes, stating the proposition 25 submitted, and showing the whole number of votes cast thereon 26 in the territory nroposed to be C.1.nnexed, the number of yotes 27 cast t.herein in favor of 3...1"lnexation, and trJ.e number of votes 28 cast therein against annexation; and 29 WHEREAS, it appears from the canvass 0 f the returns 30 of ~uch election tr..at the whole number of votes cast therein ~ 31 in the territory pro}!osed to be an.oexed, was~~/votes; 32 that the wl'lole number of ,oot.es cast :herein in favor of annexa- -3- 1 tion was &~votes; and the number of votes cast therein 2 against annexation was-?/itI4~,lotes; and 3 WHEREAS, the said City 0 f San Bernard ino had in- 4 curred a bonded indebtedness for the acquisition, construction 5 and completion of municipal improvements; and 6 WHEREAS, the pe tit ion here inb efore ment ioned, which 7 was presented to the Mayor and Corrnnon Counc il of the said City, 8 did contain a request that the question to be submitted to the 9 electors residing in the territory 'nroposed by such petition 10 to be annexed to said City of San Bernardino, sl1al1 be i]'Thether 11 such new territory shall be annexed to, incorporated in, and 12 made a part of said municipal corporation, and the uroperty 13 therein be, after such annexation, subject to taxation equal- 14 ly with the property within said City of San Bernardino to 15 pay a specified portion of such bonded inde'otedness of said 16 City of San Bernardino, out3tG.nding a.t the date of the filing 17 of said petition; and such petition particularly referred to 18 and mentioned and s~ecified the indebtedness hereinafter par- 19 ticularly ment ioned in ti1is Ord ina-nce; and 20 VJHEHEAS, the notice of the election did distinctly 21 state the proposition to be submitted, to-wit: that it is pro- 22 posed to annex to, incorporate in, and make a part of said 23 City of San Berna.rdino, the territory sought to be annexed, 24 spec ifically describin3 the bounde..ries thereof, and that the 25 property therein sh~ll, after such annexation, be subject to 26 taxation equally nirith the property \7ithin such municinaJ 001"- 27 poration to pay such specified jJortion of the oonded indebted- 28 ness of such municipal corporation outstanding at the date of 29 sa.id annexa.tion, c..nd represented oJ bonds 0 f such municipal 30 corporation; and 31 \VHEREAS, tl~e said not ic e did d is t inc tly sp ec i fy the 32 im~provement or improvements for which said indebtedness was so -4- authorized, and d.id stateche amount of said indebtedness 'Sll ready inc1.lrred, and the amount of said indcbtednes~ represent- 1 2 3 ed by bonds, 8,;1d the maximum rate of interest payable; and, 4 whereas, the ballot at said election contained all of said 5 ma t t e r s ; 6 NOW, THEREFORE, the lV[ayor and Common Counc il 0 f the 7 City of San Bernardino do ordain as follows: 8 SECTION O:!m: That the annexation of the hereinaf- 9 ter described territory, heretofore referred to in proceedings 10 of the Mayor and Common Council of the City of Sar.. Bernardino 11 as the "Mountain District", to the City of San Bernardino, a. 12 munic ipal corpora tion, be and the same is heI'eby approved; 13 that said district hereinafter described be and the same is 14 hereby annexed to the City of San :Bernard ino, a municipal corporation, and upon cornpleti'on of such annexation, t...l1e said 15 16 district shall -Je subject to taxation equally with property 17 in the City of San Bernard ino, to pay the fo llowing spec ified 18 })ortion of the "bonded indebtedness of the said City of San 19 Bernardino: 20 30nds for Public Conve,l1tion Hall, amount outstanding, 21 $175~OOO.OOJ rate of interest, five per cent per annum, payable 22 semi-annually. Said bonds are being paid in annual install- v'" 23 menta of '~5, 000.00, thirty-five of said installments being un- 24 paid; 25 Bonds for wa.ter works, consis tinf; of Antil Ra.nch, 26 rights of way, pipe lines, wells and pumping plant, amount 27 outstandinb, $28,900.00, rate of interest, four per cent per 28 annum, payuble semi-annually. 3aid bonds are being paid in vI'" 29 annual installments of $1700.00, seventeen of said install- 30 l.aents being unpaid; 31 Bonds :or water works, consisting of "Hubbard Water", 32 rights of "Nay, pipe lines~ ".}Tells and . pumping plant, amount out- -5- 1 standing, $69,275.00, rate of interest, four per cent per an- 2 num, payable semi-annually. Said. bonds are being paid in v 9 annual installments of $6,875.00, thirty-eight of said in- 10 stallments being unpaid; 11 Bonds for Fire Hall, amount outstanding, $54,000.00, 12 rate of interest, five per cent per annum, payal)le semi-an- 13 nually.
