HomeMy WebLinkAbout3715 20 21 22 23 24 25 26 1 ORDINANCE NO. .3'7/5 2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE NO. 1991 KNOWN AS THE "LAND USE ZONING ORDINANCE"; 3 AND PERMITTING AN AUTOMOBILE SERVICE STATION WHEN DESIGNED AS A PART OF AN OVERALL INTEGRATED SHOPPING CENTER DEVELOPMENT WITHOUT 4 A CONDITIONAL DEVELOPMENT PERMIT. S THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 6 7 8 !l 10 SECTION 1. Ordinance No. 1991 Section 11.1 Subsection D3 is hereby amended to read as follows: 11 I I "3. Automobile service stations, including locations wherel gasoline dispensing pumps are installed for the sale of motor I I I I fuels in combination with some other type of retail service (sub- 12 ject to a conditional development permit). Service station pump 13 islands shall not be closer than fourteen (14) feet from the 14 15 street property line which distance shall be measured from the nearest street property line to the nearest edge of the pump 16 island. No major repairs, metal work or painting shall be per- 17 mitted; only new or unused merchandise may be stored outside. 18 19 An automobile service station shall be permitted without a conditional development permit, provided that the station is designed as a part of an overall integrated shopping center development of 10 acres or more and where the commercial floor area of said development is 100,000 square feet or greater, and further provided that the Planning Commission shall have reviewed and approved the overall site plan development for the shopping center." SECTION 2. This ordinance is an urgency measure which 27 shall take effect and become operative upon its adoption and 28 approval. 1 The facts constituting such urgency are that the ordinance 2 amendment is necessary to promote the public health, safety and 3 revenue of the City of San Bernardino. The City of San Bernardino 4 is a high unemployment impact area and a commercial development 5 is proposed which will relocate to another area unless it can 6 proceed forthwith. This would result in a loss of a substantial 7 number of jobs, addi.tional sales tax revenue and a substantial 8 loss in property tax revenue to the City of San Bernardino. The 9 10 great loss to the City of San Bernardino would have a detrimental effect upon the public health, safety and welfare of the citizens 11 10f the City.
