COMMON COUNCIL DECLARES ITSELF TO
THE CITY OF SAN BERNARDINO.

WHEREAS, a public hearing has been held by the Mayor and
Common Council of the City of San Bernardino to consider whether
the Common Council of said City should adopt an ordinance

declaring itself to be the Redevelopment Agency of the City of

San Bernardino; and
WHEREAS, notices of said public hearing have been duly
published in a newspaper of general circulation, printed and
published in said City; copies of said notice have been duly
posted in the affected project areas and have been duly mailed
to all persons who have expressed to said Agency, or to the
Mayor and Common Council, an interest in receiving information
on Redevelopment activities, all notices being made in the
manner, form and within the time periods required by law; and
WHEREAS, a report was prepared to substantiate and explai
the determination that the Common Council declare itself the

Redevelopment Agency and was presented at said public hearing,
WHEREAS, evidence was presented at said public hearing
said public hearing has been closed,
NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO DO ORDAIN AS FOLLOWS:

SECTION 1. The action of the Common Council of said City

in declaring itself to be the Redevelopment Agency of said City

will serve the public interest and promote the public safety and
welfare in a more effective manner than the current organization.

SECTION 2. There has been full public disclosure of all

reports and proposals relating to the intent of the Common
Council to declare itself the Redevelopment Agency.

SECTION 3. The Common Council of the City of San Bernardi 0

hereby declares itself to be the Redevelopment Agency of the

City of San Bernardino in accordance with the provisions of the
Health and Safety Code of the State of California.

SECTION 4. All the rights, powers, duties, privileges and

immunities vested by Part 1 of Division 24 of the Health and
9
Safety Code of the State of California in the Redevelopment AgencJ
of the City of San Bernardino, except as otherwise provided
therein, shall be vested in the Common Council of the City of
San Bernardino.
SECTION 5. The Mayor and Common Council adopt those
findings of fact contained in the report presented at this public
hearing and now on file in the office of the City Clerk.
SECTION 6. This ordinance shall become effective and
operative on July 1, 1978.

LEGISLATIVE BODY REPORT
As Prescribed By
Chapter 3, Article 1, Section 33200
California Redevelopment Law
Health and Safety Code
Redevelopment Agencies created prior to 1970 generally had a
separate governing body from the legislative body. However, since
1970, almost every new agency which has been created has as its
governing body the legislative body to serve as the redevelopment
agency (source Ralph Anderson and Associates, document on Redevelop-
ment and Tax Increment Financing by Cities and Counties in Cali-
fornia, dated January 1976).
The legislative body of the City of San Bernardino, otherwise
known as the City Council, proposes to declare itself the Rede-
velopment Agency, for the City of San Bernardino, for the following
reasons:
1. The same body which is involved in the development of a
comprehensive land use plan for the jurisdiction is also responsi-
ble for developing and implementing a redevelopment plan. This
unity of action by a single body ensures coordinated planning for
community land use.
2. The legislative body serving as the redevelopment agency
and a single governing body (legislative-redevelopment) will be
responsible for approving a budget encompassing the total city.
3. The legislative body serving as the redevelopment agency
can, in effect, save expenditure of funds for legal services
required by the redevelopment function, by utilizing the office of
the elected or appointed jurisdiction's attorney.
4. A single governing body (legislative-redevelopment) will
negate the requirement for joint meetings of the legislative and
redevelopment bodies on required occasions for conducting public
hearings and/or regulate business of the redevelopment agency.
5. The elected body serving as the redevelopment agency will
be more responsive to the citizens than appointed officials as
redevelopment officers.

6. A single body (legislative-redevelopment) will negate the
requirement for duplication of records and documents - effecting a
cost saving to the taxpayer.
7. The legislative body meeting as the redevelopment agency
on alternate Mondays would provide more public access to the Council
and redevelopment business.
8. The exposure of the legislative body to all facets of basic
redevelopment matters, coupled with the mandatory "in-depth" study
required for decisions - many now rendered totally by only redevelop-
ment agency, will provide the legislative body members with a broader
scope and greater depth knowledge of redevelopment matters and over-
all city business.
9. The integral sound system in the Council Chambers will pro-
vide capability for recording total business of the redevelopment
agency with storage facilities for long-time retention of tapes.
10. The legislative body serving as the redevelopment agency
and meeting in the Council Chambers will afford greater access to
the meetings by the public due to better design and larger facilities.
11. The legislative body declaring itself the redevelopment
agency will serve the public interest and promote the public safety
and welfare in a more effective manner than the current organization.
12. There has been full public disclosure of all reports and
proposals relating to the legislative body's intent to declare itself
the redevelopment agency.
13. The legislative body serving as the redevelopment agency
will conserve manpower resources of the redevelopment supporting
staff by eliminating the requirement for double meeting attendance,
presently required, when Redevelopment Board action items are on
the Council Agenda and dictate staff appearance.
l~. The legislative (Council) body serving as the redevelopment
agency will negate the requirement for many redevelopment matters
appearing on the legislative agenda; thus, shorten the legislative
(Council) agenda.
15. To date, the members of San Bernardino's Redevelopment Agency
have not adopted a Conflict of Interest Code, nor submitted a financial
disclosure statement, as required by elected officials in accordance
with the Political Reform Act of 1974 which became effective on
January 7, 1975.
The legislative body serving as the Redevelopment Agency will be
required to comply with all provisions of the Political Reform Act of
1974 and thus negate any opportunity for personal benefit or gain
involving acquisition, development and/or sale of property.
