I - 1 RESOLUTION NO. /2!?..~. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE SALE OF APPROXIMATELY .598 ACRES OF REAL PROPERTY LOCATED AT 466 3 WEST 4TH STREET IN THE CENTRAL CITY NORTH REDEVELOPMENT PROJECT AREA TO THE CITY OF SAN BERNARDINO BY THE REDEVELOPMENT AGENCY 4 OF THE CITY OF SAN BERNARDINO (HEALTH & SAFETY CODE S 33433). 5 WHEREAS, the Redevelopment Agency of the City of San 6 Bernardino is the owner of a certain lot and parcel of real 7 property with a building, to wit: the Elk's Building, situated 8 thereon at 466 West 4th Street, San Bernardino, California, in 9 the Central City North Redevelopment Project Area, and more 10 particularly described in Exhibit "A" attached hereto and incor- 11 porated herein by reference as though set forth in full and at 12 length; and 13 WHEREAS, said real property was purchased on July 23, 14 1975 at a purchase price of nine hundred seventy-one thousand 15 five hundred nineteen dollars and fifty-five cents ($971,519.55), 16 the/fair market value of the aforesaid property for the highest 17 and best use consistent with the Redevelopment Plan; and 18 WHEREAS, the Redevelopment Agency has further expended 19 sums on said real property as follows: improvements - $175.00; 20 relocation - estimated $40,000.00; and 21 WHEREAS, the Redevelopment Agency of the City of San 22 Bernardino proposes to sell said lot and parcel of real property 23 together with the improvements situated thereon to the City of 24 San Bernardino, a municipal corporation, for the sum of eight 25 hundred eleven thousand seven hundred seventy-eight dollars 26 ($811,778.00); and 27 WHEREAS, said selling price is less than the estimated fair 28 . market value of the real property being sold; and 1 2 3 4 5 Ii 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the City of San Bernardino contemplates spending substantial sums of money to convert the building situated on said property for a public use, to wit: a police facility; and WHEREAS, said eight hundred eleven thousand seven hundred seventy-eight dollars ($811,778.00) selling price is necessary to effectuate the purposes of the Redevelopment Plan; and WHEREAS, City of San Bernardino will improve and trans- form the building situated on the property into a modern and up-to-date police facility to serve the citizens of the City of San Bernardino; and WHEREAS, notice of time and place of hearing has been given as required by law; and WHEREAS, the Redevelopment Agency has made available for public inspection and copying all of the information required by law; and WHEREAS, all hearings have been held as required by Health & Safety Code Section 33433, NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO do hereby find and declare that the sale is for less than the estimated fair market value of the lot and parcel of real property being sold determined at the highest use per- mitted under the Central City North Redevelopment Project Area Plan and that such lesser consideration is necessary to effectuate the purposes of said Plan for the following reasons: 1. The Redevelopment Plan .for the Central City North, Section C 2, A, 8, provides, allows and permits uses for civic and public purposes such as police stations, libraries, fire stations and the like. -2- 1 2 3 4 5 6 7 8 9 ~ 11 12 13 14 15 16 17 18 19 20 21 22 23 ~ 25 26 27 28 ~ : 2. The real property involved was originally pruchased on July 23, 1975 by the Agency with the understanding from the City that the City of San Bernardino would convert the building there- on into a public library, police station facility or other public building and that the development was the integral part of a plan pursuant to which the City of San Bernardino and the county of San Bernardino and the Redevelopment Agency of the city of San Bernardino entered into an exchange agreement whereby certain real property of the City of San Bernardino, including the real property upon which the existing police facility is now established, was exchanged with the County of San Bernardino for certain of its parcels of real property in order to fulfill obligations under said exchange agreement and promote planned Redevelopment by the Redevelopment Agency of the City of San Bernardino. As a result of this exchange agreement, the City must relocate its existing police facility. 3. The existing police station facility located on Arrowhead Avenue is dilapidated and in need of extensive repairs. Said facility is inadequate to meet the needs of the expanding Police Department of the City of San Bernardino. 4. The City of San Bernardino is without sufficient funds to pay for the fair market value of the property being sold to said City by the Redevelopment Agency based on the fair market value of the property determined at the highest and best use consistent with the Redevelopment Plan. If the Plan to develop this parcel of real property into a police station is to be effectuated, it can only be accomplished by the Redevelopment Agency selling this property for the sum of eight hundred eleven -3- II. 1 2 thousand seven hundred seventy-eight doLlars ($811,778.00) for the public purpose indicated herein. 5. If the Redevelopment Agency does not sell this property to the City of San Bernardino for the sum of eight hundred eleven 3 4 S 6 thousand seven hundred seventy-eight dollars ($811,778.00), which is less than the fair market value, the Redevelopment Plan for 7 this Project Area cannot be effecutated by reason of the fact that a public facility will not be constructed upon the property which will provide much greater police protection to the Central City North Redevelopment Project Area, and would thereby cause a depreciation in the fair market value of other Redevelopment 8 9 10 11 12 Projects already completed and in use in the said Project Area. 13 BE IT FURTHER RESOLVED, that the Mayor and Common Council 14 of the City of San Bernardino hereby approve the sale of the said 15 16 lot and parcel of real property with the existing building thereon upon the terms, conditions and for the reasons herein set forth. 17 I HEREBY CERTIFY that the foregoing resolution was duly 18 adopted by the Mayor and Common Council of '1 "'A..J the City of San 19 Bernardino at a on the c-2f d day meeting thereof, held 20 , 1977, by the following 21 vote, to wit: 22 .
