I� 2 AN ORDINANCE OF THE MAYOR AND COPdMON COUNCIL OF THE uITY 3 OF SAN BERNARDINO, APPROVING THE ANNEXATION OF THE WEST URBITA DISTRICT. 4 5 WHEREAS, heretofore, on the X ,5rQ day of 6 51922, a petition was filed with the Mayor and Common Council of 7 the City of San Bernardino, asking that the territory hereinafter 8 described be annexed to the City of San Bernardino; and 9 WHEREAS, said petition described said territory proposed 10 to be annexed to said City of San Bernardino; and 11 WHEREAS, said petition was signed by not less than one- 12 fourth in number of the qualified electors residing in said terri- 13 tory herein mentioned, as shown by the registration of voters of 14 I the County of San Bernardino, being the County in which said id er- W xc I ; od 15 ritory is situated; and = 1 . 0 0 " 0 16 WHEREAS, said territory is contiguous to the City of aZ „ = 17 San Bernardino ; and V0 . 18 WHEREAS, thereafter, the Mayor and Common Council of 19 l! the City of San Bernardino did, by OrdinaTice, call s special el 19 tion and submit to the electors residing in said territory pro- 21 posed by such petition to be annexed to said City of San Bernar- 22 dino, the question whether such territory shall be annexed to, in- 23 corporated in, and made a part of such municipal corporation; that 2411 said legislative body caused notice to be given of such election 25 by the publication of a notice thereof in a newspaper of general 26 circulation printed and published in the said City of San Bernar- 27 dino, at least once a week for a period of four successive weeks i 28 next preceding the date of such election; and 29 WHEREAS, there was no newspaper printed and published 30 outside of such municipal corporation but in the County in the 31 territory so proposed to be annexed is situated; and 32 WHEREAS, such legislative body caused notice of such -1� 1 [election to be given by the posting thereof in three public places ! 2 within the territory so proposed to be annexed, at least four 3 ; weeks next preceding the date of said election; and 4 wHEREAS, such notice did distinctly state the date of 5 such election, the proposition to be submitted: that it is pro- 6 posed to annex to, incorporate in, and make a part of such munici- I 7 pal corporation, the territory sought to be annexed, specifically 8 describixlg the boundaries thereof; and 9 WHEREAS, in addition to such description, such territory ' 10 1 was also designated in said notice as "West Urbita District", the 11 same being an appropriate name or words of identification by 121'! which said territory was referred to and indicated upon the b al- 131'I lots used at said election at which the question of such annexa- 14 1 tion was submitted; and W y Q � ; o ° 15 WHEREASa the electors of such territory were directed F J N U > r � 16I by such notice to vote upon such question; and same ter . - 17 j WHEREAS, the Mayor and Common Council, in said Ordinarsoe 3 18 !I', calling said election, did appoint officers for such election, 19 !! consisting of two judges and one inspector, each of whom was a 1 20 I1 qualified elector of the voting precinct in which he was appointed! 21 i to act as an officer of such election, and did designate the poll- !' 221' ing place for said election; and 23 WHEAS, the said Mayor and Common Council did cause to RE 24 be furnished, for use at said election, ballots containing the 2$ proposition to be voted on, and directed that if an elector shall 26 stamp a cross (x) in the voting square after the printed word i 27 ) "Yes", the vote of such elector shall be counted in favor of the 28 annexation of the territory, referred to in the notice, to the 29 City of San Bernardino, and if such elector shall stamp a cross 30 i (x) in the voting square after the printed word "Bo", the vote of 31 ! such elector shall be counted against such annexation; and 3211 1 WHEREAS, the ballots used at such election, the opening -2- 1 i 2 and closing of the polls, and the holding and 3 conducting of such election, was in conformity, as f 4II near as may be, with the laws of the State of S California concerning general elections, except Eli as otherwise provided by law; and 7 WHEREAS, AS, h e u es d � dB an inspector of 8 said election, immediately on the closing of 9 the polls, counted the ballots, made up and 10 certified and sealed the ballots and tally 11 sheets of the ballots cast at their respective 12 polling places, in the manner provided by law, 13 and did thereupon deliver the ballots, tally I 14 1 sheets and returns to and deposited the same W xz F < m � 15 with the City Clerk of the City of San Berner- 16 < dino �< o c " _ s � os 11! , and = p 17 WHEREAS, the said Mayor 3 < � z 8Y and Common 18 .! Council did, on the 2nd day after said election, 19 ii meet and proceed to canvass said returns and 20 ;! complete such canvass, and did, immediately upon j 2111! the completion of such canvass, cause a record 22j thereof to be made and entered upon its minutes, 23 i1 stating the proposition submitted, and showing 24 ' the whole number of votes cast thereon in the 25 territory proposed to be annexed, the number of 26j votes cast therein in favor of annexation, and 271 H the number of votes cast therein against annex- i 2811 ation; and �i 29 WHEREAS, the said Mayor and Common 30 ! Council did, on the 15th day of January,� arY, 1923, 31 being the first regular meeting of the Mayor and 32 j Common Council of the City of San Bernardino after _3- II 1 the holding of said election on the 9th day 2 of January, 1923, meet and again proceed to 3 canvass the returns of said election, and com- 4 plate such canvass, and did, immediately upon 5 - the completion of such canvass cause a record p , 61I thereof to be made and entered upon its minutes, I 7 ! stating the proposition submitted, and showing the I S whole number of votes cast thereon in the terri- I 9 tory proposed to be annexed, the number of votes I 10 ' 1 cast therein in favor of annexation, and the num- 11 bar of votes cast therein against annexation; and 12 1' WHEREAS, it appears from the canvass of i 13 : the returns of such election that the whole num- z 14 !i bar of votes cast therein in the territory pro- w U = 3m < 15 , posed to be annexed, was twenty-five votes; that 11 D c > YK 16 j, the whole number of votes cast therein in favor 2z . a! a p q w ! 17 ii, of annexation was twenty votes ; and the number VOW 6 a aw W of votes cast therein against annexation was 191 five votes ; and 20 ! ' WHEREAS, the said City of San Bernar I 21 III dino had incurred a bonded indebtedness for the I 22 acquisition, construction and completion of mu-� I 23I!I nicipal improvements ; and 24 !II !!I WHEREAS, the petition hersinbefore men- 25 ! tioned, which was presented to the Mayor and 26 ! Common Council of the said City, did contain a 27 !!!, request that the question to be submitted to 11 28 '' the also- 29 30 ! 31 , 32 3-a. 1 Fnexede residing in the territory proposed by such petition to be an- 1 i 2 to said City of San Bernardino , shall be whether such new 3 lI territory shall be annexed to, incorporated in, and made a part of 4 said municipal corporation, and the property therein be, after 5I1 such annexation, subject to taxation equally with the property 6 within said City of San Bernardino to pay a specified portion of 7 such bonded indebtedness of said City of San iernardino, outstand- , i 8 ing at the date of the filing of said petition; and such petition 9 particularly referred to and mentioned and specified the indebted- 10 ness hereinafter particularly mentioned in this Ordinance; and 11 I WHEREAS, the notice of the election did distinctly state 12 the proposition to be submitted, to-wit: that it is proposed to 13 11'. annex to, incorporate in, and make a part of said City of San Ber- 14 ! nardino, the territory sought to be annexed, specifically de- = im < 15 scribing the boundaries thereof, and that the property therein F N U I 0 . . o 16 shall, after such annexation, be subject to taxation equally with 7 . o _ 3 � 0 m 17ilthe property within such municipal corporation to pay such speci- 181' fied portion of the bonded indebtedness of such municipal corpora- I 191, tion outstanding at the date of said annexation, and represented 20Il, by bonds of such municipal corporation; and 21 1 WHEREAS, the said notice did distinctly specify the im- I 22 I,iprovement or improvements for which said indebtedness was so au- 23 I thorized, and did state the amount of said indebtedness already. i 24 incurred, and the amount of said indebtedness represented by bonds, 25 ''1� and the maximum rate of interest payable; and whereas, the ballot 6 2 at said election contained all of said matters; � 2711 NOW, THEREFORE, the Mayor and Common Council of the City it 28 of San Bernardino do ordain as follows: I 29 '' SECTION ONE: That the annexation of the hereinafter de- 30 ' scribed territory, heretofore referred to in proceedings of the 31 iMayor and Common Council of the City of San Bernardino as the West II 32 lUrbita District, to the City of San Bernardino, a municipal corpo- -4- 1 ration, be and the same is hereby approved; that said district 2 hereinafter described be and the same is hereby annexed to the 3 City of San Bernardino, a municipal corporation, and upon comple- 41 tion of such annexation, the said district shall be subject to 5 taxation equally with property in the City of Sail Bernardino, to 61i nay the following specified portion of the bonded indebtedness of 7 the said City of San Bernardino: 8 Bonds for Public Convention Hall, amount outstanding, 9 $195, 000.00, rate of interest, five per cent per annum, payable 10i1 semi-annually. Said bonds are being paid in annual installments 11 I' of $5000,00, thirty-nine of said installments being unpaid; 12 Bonds for water works consisting of Antil Ranch, rights 13 I ' of way, pipe lines, wells and pumping plant, amount outstanding$ 14 $35,700.00, rate of interest, four per cent per annum, payable W Y 6 _ < , 15 I semi-annually; Said bonds are being paid in annual installments e . 161! of $1700. 00, twenty-one of said installments being unpaid; Mzoa a 0 - 4 J < om 17 Bonds for water works consisting of "Hubbard Water", 3 ¢ „ 18 III rights of way, pipe lines, wells and pumping plant, amount out- 19 $85, 575,009 rate of interest, four per cent per annum, 20 payable semi-annually; said bonds are being paid in annual in- 21 stallments of $4075.00, twenty-one of said installments being un- I� 221 paid; 23 The territory herein referred to as being annexed to the 24 , City of San Bernardino is particularly described as follows, to- 25 wit: 26 All that portion of Blocks 26, 273 54 and 82, of the Z RANCHO SAN BERNARDINO, is per plat thereof recorded in Book 7 of 28 III' Maps, page 2, of the records of said County, and the FAIRVIEW ' I 29 1 SURVEY, as per plat thereof recorded in Book 1 of Maps, page 43, 30 of the records of said County, particularly described as follows: 31 Beginning at the intersection of the center line of Mill Street with the East line of Lot 89 continued North, of Block 27, III --- ------ - -- - --- - - - -5- I of said Rancho San Bernardino; thence South along the East line 2 of Lot 8, extended North, and the Fast lines of Lots 8, 7, 5 and ''! 3 5, of said Block 27, and the East line of Lot 34, of Block 54, ofi, 4 said Rancho San Bernardino, to the Southeast corner of said Lot 5I', 34; thence East along the North line of Lot 31 , of said Block 54, 6 !, to the center line of Lucinda Avenue, sometimes known as "I" 7I Street; thence South along the center line of said Lucinda Avenue ', 8 to the Southerly line of Colton Avenue; thence Southwesterly 9 jklong the Southerly line of Colton Avenue, to the corner of Lot 10 I'i 40, of said Fairview Survey lying furthest North; thence South- 11 easterly along the Northeasterly line of said Lot 40, to the 12 corner of said Lot 40 lying furthest East; thence Southwesterly 13 along the Southeasterly line of the Fairview Survey to the cor- 14 ner of Lot 28, of said Fairview Survey, lying furthest South; W Ye FJm < 15 I thence Northwesterly along the Southwesterly line of said Lot 28 F N U c'� wxg 16 j, and the said Southwesterly line of said Lot 280 extended North- s : as 17 westerly, to the center line of Colton Avenue; thence Northeast- I'I 3 < � = � m 18 erly along the center line of Colton Avenue, 93.05 feet ; thence 19 !I, North 24 degrees 09 minutes `Vest, 740.35 feet; thence North 44 20 degrees 11 minutes West, 424.2 feet; thence North 35 degrees 10 21 ;! minutes west, 534.15 feet; thence North 3 degrees 08 minutes west, 22 j' 374.6 feet to the Northwest corner of Lot 319 of said Block 54; 23 thence North 69 degrees 28 minutes west along the South line of 24 '1 , Lots 33 and 34, of said Block 54, and said line continued Wester 2511 ly, to the center line of Mt .
