2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO APPROVING THE ANNEXATION OF ANNEXATION DISTRICT
3 NO. 47.

4 WHEREAS, on the day of , 1950, a Petition
5 was filed with the City Council of Ci of San Bernardino re-
6 questing that certain uninhabited territory contiguous to said City
7 be annexed to the City of San Bernardino and which said Petition
8 described said territory and the boundaries thereof proposed to be
9 annexed to the City; and
10 WHEREAS, said Petition was filed by the owners of not
11 less than one-fourth of the area of land in such territory and re-
12 presenting not less than one-fourth of the assessed value of such
13 territory according to the last preceding equalized assessment roll
14 of the County of San Bernardino, in which said County the City of
15 San Bernardino is situated; and
16 WHEREAS, the said Petition requested the said territory
17 to be annexed to and included in the said municipal corporation, in
18 accordance with the provisions of Act #5162, Deering1s General Laws
19 of the State of California, commonly known as the Annexation of
20 Uninhabited Territory Act of 1939, Chapter 297, as thereafter amen-
21 ded; and
22 WHEREAS, all and each of the owners of all of the afore-
23 mentioned real property and of each and every parcel contained
24 therein have consented in writing and filed with the City Clerk of
25 the City of San Bernardino, who acts as Clerk for said City Council,
26 their consent and agreement that all of the property included in the
27 aforesaid territory shall be taxed equally with the other property
28 within the said City to pay the bonded indebtedness and any and all
29 general indebtedness and liability of the City of San Bernardino

1 WHEREAS, on the 24th day of July, 1950, a Resolution was
2 I adopted by the aforesaid City Council of the City of San Bernardino
3 California,, proposing the annexation of the aforesaid uninhabited
4 II' territory to be generally known as the ANNEXATION DISTRICT NO. 47
gito the City of San Bernardino, and that said Resolution provided
6 therein that the said proposed, annexation should be generally known
7 ', and identified as the ANNEXATION DISTRICT NO. 47; and

8 WHEREAS, said Resolution set forth therein that all of

9 Ithe property included in the aforesaid territory should be taxed
10 i1bonded ilequal with the other property within the said City to pay the
11 indebtedness and any and all general indebtedness and lia-
12 jbility of the City of San Bernardino, contracted prior to or exist-
i
13 jing or outstanding at the time of the aforesaid proposed annexation

14 11of the aforesaid property, as provided in Section 10 of the herein-
,
15 11before mentioned act; end

16 WHEREAS, the said Resolution did fix, determine and declare
17 that a hearing would be held on the 21st day of August, 1950, at the
18 hour of 7:30 p.m. in the Council Chambers in the City Hall in the
19 City of San Bernardino, (which is located on Third Street between
20 "D" and "Ell Streets in said City) , and same was the day, hour and
21 place designated where any person owning real estate within such
22 territory so proposed to be annexed and having any objection to the
23 proposed annexation might object before the City Council and show
24 cause why such territory should not be annexed, and furthermore, the
25 said Resolution provided that at any time not later than the said
26 our set, as mentioned hereinbefore for the said hearing, any owner
27 of property within the said territory proposed to be annexed might
28
file written protest with the City of San Bernardino against such

3 and form and in all other respects as provided. by law; and
4 E WHEREAS, no objections or protests of any kind or nature
g whatsoever were made or filed, either written or oral, with the
6 said. City of San Bernardino and no protests or objections of any
7 nature whatsoever were made, either written or oral, at the meeting
8 of the City Council on the 21st day of August, 1950, as mentioned
9 hereinbefore, at which said meeting the said City Council publicly
10 `i announced that any person, firm or corporation desiring to protest
11 I� or object to said annexation might do so at said meeting; and
12 ( WHEREAS, it appears to the City Council of the City of
13 San Bernardino that the aforesaid annexation proceedings have been
14 completed and everything performed at this time, in accordance with
15 the provisions of Act x#5162, Deeringfs General Laws of the State of
16 California, as amended, and mentioned hereinbefore, and any and all
17 other laws in any way connected with the said annexation procedure,
18 have been complied with; and
19 I WHEREAS, the City Council of the City of San Bernardino
20 desires to approve at this time the annexation of the aforesaid
21 territory.
22 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN BER-
23 NARDINO DOES ORDAIN AS FOLLOWS:
24 SECTION ONE: That said territory so herein described as
25 Annexation District No. 47 is hereby annexed and incorporated in
26 and made a part of the City of San Bernardino.
27 SECTION TWO: The territory herein referred to as being
28 annexed to the City of San Bernardino is particularly described as
29
follows, to-wit:

1 it the west line of said Block 5, of said Orange Grove
Tract, being also along the east line of Lot 6,
2 Block 40, Rancho San Bernardino, as per plat there-
of recorded in Book 7 of Maps, at Page 2, records
3 of the County Recorder of San Bernardino County
and being along the present corporate limits of
4 the City of San Bernardino, 244.40 feet, to a point
569.10 feet North of the southeast corner of said
5 Lot 6, of said Block 40, of said Rancho San Ber-
nardino* thence North 670 221 West, being along
g the present corporate limits of the City of San
Bernardino, 594.40 feet; thence South 890 53' West,
? being along the present corporate limits of the
City of San Bernardino, 280.96 feet; thence South
g 33° 541 30n East, 401.92 feet; thence Southeast-
erly along a curve concave to the northeast and
9 having a radius of 2820 feet a distance of 312. 54
feet; thence South 400 151 36" East, 268.40 feet;
10 thence Southeasterly along a curve concave to the
southwest and having a radius of 830 feet, a dis-
11 tance of 13.76 feet, to a point in the south line
of said Lot 6, of said Block 40, of said Rancho
12 San Bernardino; thence Southeasterly along a curve
concave to the southwest and having a radius of
830 feet a distance of 527.54 feet; thence South
13 2053f 30� East, 125.60 feet; thence Southeasterly
along a curve concave to the' east and having a
14 radius of 1820 feet, a distance of 169.15 feet;
15 I thence South 80 131 East, 182.21 feet, to the
north line of Pacific Avenue; thence Easterly along
the north line of Pacific Avenue to a point in
16 the east line of Lot 6, Block 52, of said Rancho
San Bernardino, said point being 20 feet North
17 of the southeast corner of said Lot 6, Block 52,
of said Rancho San Bernardino; thence Northerly
18 along the east line of said Lot 6, Block 52,
of said Rancho San Bernardino, to the southeast
19 corner of Block 5, of said Orange Grove Tract;
thence Westerly along the south line of Block 5,
20 of said Orange Grove Tract, being along the pre-
sent corporate limits of the City of San Bernar-
21 dino, to the point of beginning.
22 SECTION THREE: The above described property shall be sub-
23 ject to taxation, equally with the property within such municipal
24 corporation, to pay its proportion of the following bonded indebted
25 ness of the City of San Bernardino, which said bonded indebtedness
26 was outstanding at the time of filing said Petition or theretofore
27 authorized and is outstanding at the time of said annexation, to-wit:
28 A bonded indebtedness of $200,000.00 incurred for
the construction and completion of a convention
29 hall, the outstanding indebtedness thereon being

1 rights of way, pipe lines, wells and pumping plants,
the outstanding indebtedness thereon being $103,125.00,
2 1 bearing interest at the rate of 5% per annum.
3 A bonded indebtedness of $650,000.00, incurred for
IE the acquisition of real property, and construction
4 of a sewage disposal plant, inverted siphon sewer
!i lines and intercepting sewers, the outstanding in-
s debtedness thereon being $194,999.94, bearing in-
terest at the rate of 0% per annum.

SECTION FOUR: This Ordinance shall be in force and take
7 effect from and after thirty days after its passage and approval.

ii SECTION FIVE. The City Clerk shall certify to the passage

1I of this Ordinance and shall cause the same to be published three
10
iconsecutive times in the San Bernardino Evening Telegram, a daily

;jnewspaper designated for that purpose.
