ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDIIQG ORDINANCE
NO. 3473 ENTITLED IN PART °ORDINANCE . . . REGULATING . . .
3 POLITICAL SIGNS" ; AND DELETING THEREFROM THE FEE FOR A PERMIT AND
SUMMARY ABATEMENT PROCEDURES.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWS :
6 SECTION 1. Ordinance No. 3473 Section 3 Subsection (b) is
7 hereby amended to read as follows:
8 " (b) Prior to the placement of political signs in the
9 incorporated areas of the City, a permit shall be obtained from
10 the Superintendent of the Building and Safety Department of said
11 City who shall issue the permit subject to the regulations and
12 provisions of this ordinance. The applicant for a permit shall,
13 in writing, state the name of the owner of the sign or signs and
14 that the applicant is the authorized agent of the owner. "
15 SECTION 2. Ordinance No. 3473 Section 3 Subsection (c) is
16 hereby amended to read as follows :
17 " (c) Political signs shall not be posted or erected on
18 any property without the consent of the property owner or his agent.
19 The applicant for a permit shall submit a list of locations where I
20 political signs are intended to be posted or erected and shall
21 certify, under penalty of perjury, that oral consent has been
22 obtained from the owner or agent of said locations. The political
23 signs shall be posted or erected only at the locations shown on
24 the said listing. "
25 SECTION 3. Ordinance No. 3473 Section 3 Subsection (j ) is
26 hereby amended to read as follows:
27 " (j ) If a political sign is deemed to be in violation of
28 this ordinance, the Superintendent of the Building and Safety

1 Department or his authorized representative shall give the sign
2 owner, or his agent, written notice that he intends to remove the
3 sign if the violation is not corrected, and a brief statement of
4 the reason for the belief that the sign is in violation of this
5 ordinance. Such notice shall be served either personally or by
6 depositing in the United States Mail addressed to the sign owner,
7 or his agent, at the address shown on the application for a permit
8 with postage prepaid thereon. Personal service shall be con-
9 sidered effective when made and service by mail shall be con-
10 sidered effective three days after depositing the notice in the
11 United States Mail as provided herein. The sign owner, or his
12 agent, may respond orally or in writing or correct the ordinance
13 violation not later than one day after service of said notice. If
14 the ordinance violation is not corrected by the second day after
15 the service of notice is effected, the Superintendent of the
16 Building and Safety Department, or his authorized representative,
17 shall remove the sign. If the owner, or his agent, of any illegal
18 sign does not reply to the notice within one day after service of
19 said notice is effected, the sign shall be deemed abandoned and
20 shall be removed on the second day after service of the notice is
21 effected as aforesaid. "
22 SECTION 4. Ordinance No. 3473 Section 3 Subsection (k) is
23 hereby amended to read as follows:
24 " (k) The applicant shall sign a statement filed with the
25 Superintendent of the Building and Safety Department indicating
26 that such person understands the political sign regulations and
27 that signs which do not conform thereto are subject to removal
28 and abatement under the provisions of Section 3 Subsection (j )

2 SECTION 5. Ordinance No. 3473 Section 3 is hereby amended
3 by adding thereto Subsection (1) to read as follows :
4 " (1) The provisions of this ordinance, Ordinance No. 1991
5 and Ordinance No. 2623 shall not be applicable to political signs
6 erected or posted on any occupied residential premises. "
7 SECTION 6. URGENCY. This ordinance is an urgency and
8 emergency measure and shall take effect upon its adoption and
9 approval. The facts constituting such emergency are as follows :
10 The general election is to be held on November 2, 1976.
11 Therefore, it is imperative that this amendment to this regulatory
12 ordinance become effective before political signs are erected by
13 candidates who have filed nomination papers for election in order
14 that their freedom of speech can be appropriately exercised.
15 I HEREBY CERTIFY that the foregoing ordinance was duly
16 adopted by the Mayor and Common Council of the City of San
