Ali ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BFRNARDINO APPROVING THE ANNFiJKATION OF ANNEXATION DISTRICT
NO. 43.
WHEREAS, on the 7th day of March} 1949, a, Petition was
filed. with the City Council of the City of San Bernardino request
that certain uninhabited territory contiguous to said City be an-
nexed to the City of San Bernardino and which said Petition des-
cribed said territory and, the boundaries thereof proposed. to be
annexed to the City; and,
WHEREAS, said Petition was filed by the owners of not
less than one-fourth of the area of land in such territory and re-
presenting not less than one-fourth of the assessed value of such
territory according to the last preceding equalized assessment roll
of the County of San Bernardino, in which said County the City of
San Bernardino is situated; and,,
WHEREAS, the said. Petition requested the said territory
to be annexed to and included in the said municipal corporation,: in
accordance with the provisions of Act #5162, Deeringts General Laws
of the State of California, commonly known as the Annexation. of
Uninhabited. Territory Act of 1939, Chapter 297, as thereafter
amended; and,,
WHEREAS, all and each of the owners of all of the afore-
mentioned real property and of each and every parcel contained
therein have consented in writing and filed with the City Clerk of
the City of San Bernardino, who acts as Clerk for said City Council
their consent and agreement that all of the property included in th
aforesaid territory shall be taxed equally with the other property
thin the said City to.pay the bonded indebtedness and any and all
29I1general indebtedness and liability of the City of San Bernardino

ontracted. prior to or following or outstanding at the time the
oresaid petition of the annexation was filed and subsequent theret�,
321�_s provided in Section 10, as amended in the aforesaid act; and,,

WHEREAS, on the 18th day of April, 1949, a Resolution
was adopted by the aforesaid City Council of the City of San Bernaril
dino,, California, proposing the annexation of the aforesaid unin-
habited territoryto be generally known as the A.NNEXATTOD' DISTRICT
NO. 43 to the City of San Bernardino and that said Resolution pro-
vided therein that the said proposed annexation should be generally

known and identified as the ANNFXATION DISTRICT NO. 43; and, �
WHEREAS, said Resolution set forth therein that all of
the property included in the aforesaid territory should be taxed
ecivally with the other property within the said City to pay the

bonded indebtedness and any and all general indebtedness and lia-
bility of the City of San Bernardino., contracted prior to or exist-
ing or outstanding at the time of theaforesaid proposed. a.nnexa.tion
of the aforesaid property, as provided. in Section 10 of the herein
before mentioned act; and,
WHEREAS, the said Resolution did fix, determine and
declare that a hearing would. be held on the 16th day of May, 1949,
at the hour of 7:30 p.m. in the Council Chambers in the City Hall
in the City of San Bernardino, (which is located on Third Street
between 11D" and TIE11 Streets in said City), and same was the day,
hour and place designated where any person owning real estate with
such territory so proposed to be annexed and having any objection
the proposed annexation might object before the City Council and
show cause why such territory should not be annexed., and furthermore,,
the said Resolution provided that at any time not later than the said
hour set, as mentioned hereinbefore for the said nearing, any owner

of property within the said territory proposed to be annexed might
file written protest with the City of San Bernardino against such
annexation; and,
WHEREAS, it was provided in said. Resolution that the said
Resolution should be published in the San Bernardino Evening Tele- 1
igram., a newspaper of general circulation within the City of San

Bernardino, and that said Resolution was thereafter so published
in the San Bernardino Evening Telegram, as mentioned, in a manner
and form and in all other respects as provided by law; and,.
WHEREAS, no objections or. ,protests of any kind or nature
whatsoever were made or filed, either written or oral, with the
said City of San Bernardino and no protests or objections of any
nature whatsoever were made, either written or oral, at the meetin
of the City Council on the 16th clay of May, 1949, as mentioned her -
inbefore, at which said meeting the said City Council publicly
announced that any person, firm or corporation desiring to protest
or object to said annexation might do so at said meeting; and,
WHEREAS., it appears to the City Council of the City of
San Bernardino that the aforesaid annexation proceedings have been
completed and everything performed at this time,, in accordance with
the provisions of Act #5162, Deering's General Laws of the State of
California, as amended and mentioned hereinbefore, and any and all
other laws in any way connected with the said annexation procedure,
have been complied with; and,
WHEREAS, the City Council of the City of San Bernardino
desires to approve at this time the annexation of the aforesaid
territory.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN
BERNARDINO DOES ORDAIN AS FOLLOWS:
SECTION ONE: That the City Council does hereby find,
j determine and declare that all of the recitals contained in this
Ordinance are true and correct.
SECTI:3N TWO: The territory herein referred to as being
lannexed to the City of San Bernardino is particularly described as
follows,, to -wit:
BEGINNING at a point in the present corporate limits
of the City of San Bernardino, said point being the
Northeast corner of the intersection of " J" Street
and Grant Avenue, as shown on plat of Bunker Hill
Square No. 2, Tract No. 1938. as recorded in Book 28
of Maps, at page 24, records of. the County Recorder

of San Bernardino County, said point being also the
Southwest corner of Lot 35, Block 54, Rancho San
Bernardino, as per plat recorded in Book 7 of Baps,
at page 2, records of the County Recorder of San
Bernardino County; thence Easterly along the South
line of said Lot 35, Block 54, of said Rancho San
Bernardino, and being along the present corporate
limits of the City of San Bernardino, to a point
33 feet Vlest of the East line of "If' Street; thence
Northerly and parallel with the East Line of III?,
Street, being along the present corporate limits of
the City of San Bernardino, 430 feet; thence
Westerly and parallel with the South line of said
Lot 35, Block 54, of said Rancho San Bernardino,
and being also parallel with the North line of
Grant Avenue, to the East line of "J" Street as
shown on plat of Bunker Hill Square, as recorded.
in Look 21 of Maps, at page 48, records of the
County Recorder of San Bernardino County, the East
line of IIJn Street being the present corporate
limits of the City of San Bernardino; thence Southerly
along the East line of "J" Street, being along the
present corporate limits of the City of. San Bernar-
dino,:. 430 feet to the point of beginning.
SECTION THREE: The above described property shall be
subject to taxation, equally with the property within such munici-
pal corporation, to pay its proportion of the following bonded
indebtedness of the City of San Bernardino,: which said bonded in-
debtedness was outstanding at the time of filing said Petition or
theretofore authorized and is outstanding at the time of said.
annexation, to wit:
A bonded indebtedness of_' f;,200, 000.00, incurred for
the construction and completion of a convention
hall, the outstanding indebtedness thereon being
�v75,000.00, bearing interest at the rate of 5%u per
annum;
A bonded indebtedness of $275,000.00, incurred for
the acquisition and construction of water works,.
including I'Devil Canyon Water Works?, water rights,
rights of way, pipe lines, wells and pumping plants,.
the outstanding indebtedness thereon being
$123,750.00, bearing interest at the rate of 5%
per annum;
A bonded indebtedness of $650y000.0O,, incurred for
the acquisition of real property, and construction
of a sewage disposal plant, inverted siphon sewer
lines and intercepting sewers, the outstanding in-
debtedness thereon bein' $259,999.94, bearing in-
terest at the rate of J+ta per annum.
SECTION POUR: This Ordinance shall be in force and take
effect from and after thirty days after its passage and approval.

SECTION FIVE: The City Clerk shall certify to the pas-
sage of this Ordinance and shall cause the same to be published
three consecutive times in the San Bernardino Evening Telegram., a
daily newspaper designated for that purpose.
I HEREBY CERTIFY that the foregoing Ordinance was duly
adopted by the Mayor and Common Council of the City of San Bernar-
dino at a regular meeting thereof held on the day of June.,
1949, by the following vote,. to -wit. -
