Amending Chapter 10.52 of the San Bernadino Municipal code

It is recommended that the Mayor and City Council of the City of San
Bernardino, California:
1.Hold a Public Hearing ; and
2.Introduce , read by title only, and waive future reading of the Ordinance No.
MC-1651, Amending Chapter 10.52 of the San Bernadino Municipal Code to
Update Existing Speed Zones City Wide, and
3.Schedule the adoption of Ordinance No. MC-1651 to the regular scheduled
meeting of the Mayor and the City Council on May 21, 2025.
Recommendation
What is an Engineering and Traffic Survey (E& TS) ?
•An Engineering and Traffic Survey is a study conducted to determine the
appropriate speed limits for roadways in the State of California and through
out the Country.
•Without a current E&TS, speed limits enforced by radar may not hold up in
court. Courts may dismiss speeding tickets if there's no up-to-date E&TS on file.
•Helps avoid speed traps and ensures that speed zones are realistic and
consistent with driver expectations.
•It uses the 85th percentile speed—the speed at or below which 85% of drivers
travel under normal conditions—as a benchmark for setting safe and reasonable
limits.
•The adoption of an Engineering and Traffic Survey (E&TS) is an important
step in ensuring that speed limits on the City’s roadways are set in
compliance with State regulations, promote public safety and reflect current
traffic conditions.
•E&T Surveys are prepared under the direction of CVC Sections 627,22350-
22359, and 40801-40803. The CVC also requires that the surveys be
conducted based on the methodology required by the California MUTCD
Revision 8 (California MUTCD) dated January 2024.
•An E&T Survey conducted more than 7 years ago may be extended to 14
years (previously to 10 years) if a traffic engineer certifies that no changes in
roadway or traffic conditions have occurred [CVC 40802 (c)(2)(B)(i)(II)].
Safety Corridors – New from AB 43
•The provisions of CVC Section 22358.7, a new section added through AB 43,
to additionally lower the speed limit by designating a safety corridor,
•Retain Currently Adopted or Restore Immediately Prior Speed Limit – New
from AB 43.The City may retain the currently adopted speed limit without
further reduction or restore the immediately prior adopted speed limit
without further reduction as provided in CVC Section 22358.8, added
through AB 43.

Results
•48 street segments will retain their current speed limits and qualify
for a 14-year extension.
•90 street segments have recommended changes to the posted
speed limit.
•19 street segments will maintain their existing speed limits.
•114 street segments have been designated as safety corridors, with
71 street segments resulting in additional reduced speed limits.
