CLOSED SESSION REPORT
City Attorney Sonia Carvalho stated that there was reportable action on multiple items
from Closed Session. City Attorney Carvalho reported that Ashley Granick of the law
firm of Goldman, Madeline and Strassmann presented three cases to the city council.
All three cases were approved for settlement, Item A(i) for Janet Aguayo was approved
for $125,000.
Item A(ii) Micheal Fowler was approved for $35,000.
Item A(iii) for John Phillips case was approved for $150,000.
Amir Raza of the law firm of Lawrence, Beach, Ellen and Choi presented on two cases,
for Item A(v.) Angelina Ortega case was approved for a settlement of $97,500 by a 7 to
0 unanimous vote.
Item A(vi.) David Wood was approved for a settlement of $299,500, with a vote of 5 to 2,
with Council Members Ortiz and Shorett voting in no.
Victor Ware of the law firm Graves and King presented on Item A (iv.) Tiffany Ann
Harrison and a settlement of $69,999 was approved by a unanimous vote.
Updates were provided on the remaining items. Item C would be taken at the conclusion
of the open session agenda.

Feldheym Central Library, San Bernardino, CA.

The Mayor and City Council presented the proclamation to Junior Vice Commander for

PUBLIC HEARINGS
2. Resolution Approving the Issuance of Revenue Obligations by the California
Enterprise Development Authority through Benevolence Industries Inc., a
Federally qualified Health Center Agency within San Bernardino City Limits
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino
(“City”) adopt Resolution No. 2025-001 approving the issuance of revenue obligations
by the California Enterprise Development Authority (“Authority”) following a public
hearing in accordance with the requirements of the Federal Tax Equity and Fiscal
Responsibility Act (“TEFRA”) to conduct such a hearing under the authority of the
local jurisdiction, and Internal Revenue Code of 1986 as amended (“Code”).
Mayor Tran opened the public hearing at 6:49 p.m.
Director of Community Development and Housing, Gabriel Elliot provided an overview
of the request for Resolution by Benevolence Industries Inc.
There were four (4) requests to speak, however it was determined that the speakers
signed up for the incorrect item.

Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California, adopt Resolution No. 2025-002 of the Mayor and City Council of the City
of San Bernardino, California, approving the vacation of a portion of Iola Place east of
North “D” Street, and north of West Baseline Street, and the reservation of utilities
therein.

Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California: 1. Hold a Public Hearing 2. Adopt Resolution No. 2025-003 of the Mayor and City Council of the City of San Bernardino, California, calling an election to submit to the qualified electors the question of levying a special tax within the area proposed to be annexed to Community Facilities District No. 2019-1 (Maintenance Services) (Annexation No. 47); and 3. Hold a special Landowner election and canvass the election; and
4. Adopt Resolution No. 2025-004 of the Mayor and City Council of the City of San
Bernardino, California, declaring election results for Community Facilities District

Development Code Amendment 24-04 amending Chapter 19.04 (Residential
Zones); Section 19.04.030(2)(P) (Residential Zones Specific Standards -
Accessory Dwelling Units) of the City of San Bernardino Development Code
(SBMC Title 19) in order to update the development standards for Accessory
Dwelling Units in compliance with recent changes in state law; and finding such
action statutorily exempt from the California Environmental Quality Act under
Public Resources Code Section 21080.17 (Attachment 1 and Attachment 2).

Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California, adopt Resolution No. 2025-012:
1. Establishing salary assignments for the classifications of Homeless Outreach
Specialist Homeless Outreach Coordinator, Police Records Manager, Police
Dispatch Manager, Economic Development Specialist, Senior Economic
