•San Bernardino Municipal Code (SBMC) 8.60.020 allows for
the sale, use, possession, and discharge of fireworks
designated as “safe and sane.”
•The City currently allows up to 35 licenses to nonprofit
agencies for the sale of “safe and sane” fireworks each year.
Sales of Safe and Sane Fireworks
Must be a Non-Profit Organization;
Provide a Sketch of firework stand and location;
Submit the $50 Application Fee and $204 License Fee;
Provide the Certificate of Insurance ($1m in Public Liability &
Property damage;
Provide a State Fire Marshal’s Permit;
Obtain a temporary sales permit from the Dept. of Tax Fee &
Administration;
Provide a Clean Up deposit of $300 (refundable).
Requirements For Sales
The purpose of the regulatory fee is to:
Raise funds to cover for the regulatory costs of issuing the
permits;
Enforce the provisions of the Code, including extra
personnel time for inspection and enforcement duties.
Sales from the sale of fireworks is approximately $100,000
annually;
Costs for regulation and enforcement is approximately
$270,000 annually.

Establish a one- year temporary moratorium in Fiscal year
2025-26 on the sale and use of Fireworks and;
Allow staff to reassess whether is should continue to
allow the sale and use of fireworks within the City or
entirely ban their sale and use in the future.

RECOMMENDATION

Adopt Resolution No. 2025-301 setting the 2025 Regulatory Fee Rate
of 10% for the sale of “Safe and Sane” fireworks in the City;
OR
•Introduce, Read by title Only, Waive Further Reading of, and Adopt
Urgency Ordinance MC-1652 adding the new Section 8.60.180 to the
City’s Municipal Code (“Code”) establishing a one-year moratorium
on the sale and use of the safe and sane fireworks in the City; and
•Direct Staff to Prepare a Regular Ordinance establishing a one-year
moratorium on the sale and use of safe and sane fireworks in the
Recommendation
