Regular Meeting Minutes May 7, 2025 Mayor and City Council of the City of San Bernardino Page 3 Attendee Name Title Status Arrived INVOCATION AND PLEDGE OF ALLEGIANCE Pastor Lee Coe from Calvary Chapel lead the invocation and Mayor Pro-Tem Juan Figueroa led the Pledge of Allegiance. CLOSED SESSION REPORT Assistant City Attorney Albert Maldonado announced that there were two items to report on. He would report on the first and defer to the Mayor to report on the second. Assistant City Attorney Maldonado reported that the City Council unanimously voted to approve the total proposed settlement of $4,875,000 for items A(i) and B(i), noting that both claims are associated. Mayor Tran read the following statement on behalf of herself and the City Council for item B(ii) denying the claim for Treasure Ortiz: “We do have a city statement related to a denial of council member Ortiz claim GHC000082770. On March 28th, 2025, Council Member Ortiz filed a claim for $2 million against the City of San Bernardino alleging that a former detective in the San Bernardino Police Department conducted an illegal search of her criminal history and then shared that information with her political opponent. In her initial report on the matter to Chief Goodman and in numerous social media posts and recorded videos she stated that she has never been arrested. Following a thorough review of facts and circumstances, surrounded the original report to Mr. Goodman and the claim that she filed in the city, finds the information in the claim to be false and dishonest. The city's review of this matter determined that the California Law Enforcement Telecommunication System also known as CLETS, was lawfully assessed by authorized law enforcement personnel in March of 2020. The city's investigation finds the claim to be frivolous filed in bad faith dishonest in an attempt to swindle the City of San Bernardino out of $2 million. For the reasons uncovered during the investigation into her allegations and the review of this claim the city denies the claim. Ms. Ortiz will have six months to file a lawsuit should she decide to pursue the matter If she does the city is putting her and her attorney on notice that it will seek to recover all attorney fees and cost in accordance with the California Code of Civil Procedure. Furthermore, given that the false claims were filed under the penalty of perjury and it is a crime to make a knowingly false claim against a police officer, the potential criminal conduct associated with a claim is being reviewed. Given that the filing of a $2 million claim by a sitting Council Member is highly unusual and has been a subject of news and social media Regular Meeting Minutes May 7, 2025 Mayor and City Council of the City of San Bernardino Page 4 reports, the city will release information related to the investigation that was conducted and reviewed in connection with the evaluation of the claim. Mayor Pro-Tem the Council Members and myself all hope that this transparency will bring to light the serious misrepresentations made by Ms. Ortiz. Her conduct as a Council Member must not be above reproach and her reckless allegations must be stopped before they result in real liability to the city. Thank you.” PRESENTATIONS 1. Proclamation for National Police Week in the City of San Bernardino – May 11 – 17, 2025 (All Wards) The Mayor and City Council presented the proclamation to Captain. At this time Mayor Tran reordered the agenda, hearing Item Nos. 10 and 11 of the Consent Calendar before Presentation Item No. 2 due to a check presentation by Supervisor Joe Baca Jr. There were no public comments for Item Nos. 10 and 11. 10. Approval of a Funding Agreement with the County of San Bernardino in the amount of $569,250 with $189,750 of City matching funds for Newmark Field Improvements (Ward 4) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California, Adopt Resolution No. 2025-280: 1. Authorizing the City Manager, or designee, to execute a Funding Agreement with the County of San Bernardino to receive $569,250 in County funds for Newmark Field Improvements; and 2. Approve matching funding in the amount of $189,750 from the City’s CIP Fund; and 3. Authorizing the City Manager, or designee, to conduct all additional negotiations, signings, and submittals of necessary documents to receive the County funds; and 4. Resolution Imposing Liens on Certain Parcels of Real Property for Unpaid Business Registration Taxes and Penalties (All Wards) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California: 1. Conduct a public hearing to receive public comments on the matter; and 2. Adopt Resolution No. 2025-278 of the Mayor and City Council of the City of San Bernardino, California, imposing liens on certain parcels of real property for unpaid business registration taxes and penalties; and 3. Direct the Finance and Management Services Director to remove any properties from the Business Registration Lien List (Exhibit A to the Resolution) which are resolved prior to the hearing. Mayor Tran opened the Public Hearing at 5:31 p.m. Business Registration Manager Minerva Berumen gave the presentation. There were no public comments. Highlights included new businesses in the city, the new animal shelter and adoption shelter, the re-opening of Inghram Library, homeless outreach at Nunez Park, the hiring of veterinarian per diem, and the new city phone number. PUBLIC COMMENTS FOR ITEMS LISTED AND NOT LISTED ON THE AGENDA Al Palazzo expressed his desire to become the City Manager and spoke on his vision to rebuild the city. Hector Martinez, a day laborer, asked the Mayor and City Council to stop Code Enforcement harassment and requested to use a nearby vacant city-owned lot for work and food vendors. Juan Carlos Alberto, a day laborer, asked the Mayor and City Council to stop Code Enforcement harassment. Alexis Teodoro, Pomona Economic Opportunity Center, spoke in support of day laborers and reported harassment by Code Enforcement. Regular Meeting Minutes May 7, 2025 Mayor and City Council of the City of San Bernardino Page 8 Angel Lira, Pomona Economic Opportunity Center, spoke on the harassment received by Code Enforcement and requested a meeting with Councilmember Ibarra to address the issue. Loretta Hunter spoke on item 8 and expressed frustration over the Code Enforcement liens on her property. She is in compliance and requested a resolution to prevent her losing her home. Luis Ojeda spoke on several topics including, code enforcement maintenance fees for vacant lots, repeated use of single contractors, and advised against removing the City Attorney before hiring a permanent City Manager. Joe Salas, resident of the 4th ward, commended the City Council for budget reserves and street improvements, supported regular contract reviews, and called for more transparency and consistency in the city processes. Gina Mirelez spoke on the Mountain View Park Homeowners Association (HOA), corruption, real estate fraud, and lack of accountability. She also spoke on the San Bernardino Police Department failed to investigate reported crimes. Eddie Torres, Director of Pomona Economic Opportunity Center, expressed solidarity with day laborers and street vendors in San Bernardino, particularly those outside the local Home Depot. Ivan Garcia, asked to increase efforts from city departments, requested updates to the development projects website, and better outreach to businesses on Citizens Request Management (CRM) use. Harry Hatch expressed concern over comments made by the Mayor, stating they may have violated the Brown Act by disclosing information from closed session. Fay Aldridge, Arrowview Neighborhood Association, shared the positive impact of the “Love Your Block” grant on community engagement. Benny Fernandez spoke about homes being built behind existing homes, the increase of traffic, parking issues, and poor property maintenance. Juan Ruiz spoke about the Mountain View Park HOA, the lack of transparency and legal action without proper notice. Oliver Yidoz spoke about the Mountain View Park HOA, and being a victim of real estate fraud, and requested a police investigation and forensic audit. Ed Mustafa spoke about the Mountain View Park HOA, citing inaction by local authorities and requested a full investigation. Dolores Armstead asked for updates to the city’s strategic plan, zoning reforms, contract transparency, caution with military equipment for police, and an update on the “Oxbow”. Georgia L. condemned the city’s handling of animal services, citing neglect, misuse of funds, and unqualified leadership. He also urged the council to prioritize transparency, cost savings, and effective leadership. Angel F. Atuerta Jr. requested that the restrooms at 179 East Rialto Avenue Park be made accessible without fees, citing frequent community use. John Shollenberger spoke on past council decisions, including the firing of a publicity company and changes to city oversight, while expressing support for holding officials accountable. Sharon Negrete criticized the council for inaction, neglecting animal welfare, and spoke in opposition to the Member Ortiz’ lawsuit. Lydia Savala spoke on the rise in shelter intake and criticized current policies for failing to reduce pet overpopulation. Junior Carrillo commended city efforts in addressing homelessness, highlighting successful outreach in parks and the significant waste removal. Kim Calvin urged to seek proposals for a new city attorney and spoke on the lack of transparency regarding the attorney’s performance evaluations and ongoing lawsuits. Resolution Declaring Intention to Conduct a Public Hearing on July 2, 2025, to Consider Adjusting the Maximum Permitted Service Rates for Integrated Solid Waste Collection, Processing, And Disposal Services (All Wards) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, Adopt Resolution No. 2025-285, Declaring its intention to conduct a public hearing on July 2, 2025, to consider adjusting the maximum permitted service rates for integrated solid waste collection, processing and disposal services. Council Member Sanchez pulled the item for discussion. The council discussed a proposed 5% increase in waste service rates, consisting of a 2.61% CPI adjustment and a 2.39% increase for Senate Bill 1383 program costs. Despite the increase, the city maintains the lowest rates in the region. The council emphasized transparency and effective negotiation for future deals, with staff ensuring the accuracy of the 218 notices. Legal confirmed that a new notice would only be needed if the rate increase exceeded the amount noticed. Approve the award of the Construction Agreement with Matich Corporation, in the amount of $4,750,755.00 for the Pavement Rehabilitation at Fourteen Locations (Project); and 2. Authorize the project construction, construction contingencies, construction management, staff administrative costs, and independent soil and pavement testing, in the total amount of $1,500,000 for construction of the project; and 3. Authorize the City Manager or designee to execute all documents with Matich Corporation; and 4. Authorize the City Manager or designee to expend the contingency fund, if necessary, to complete the project. Council Member Sanchez and Council Member Ortiz pulled the item for discussion. The council discussed upcoming street paving projects, focusing on 14 locations identified through the Pavement Management Analysis (PMA), with a new plan to be completed in August. The projects span multiple wards, addressing both residential and arterial roads. There were questions on the bidding process, with a focus on ensuring fairness and transparency. The procurement process uses Planet Bids, allowing contractors to register and submit bids. In addition, future projects will address additional streets, with funding from Senate Bill 1 and potentially Community Development Block Grant (CDBG). There is a plan for 200 street locations in total, and Measure S funding will be allocated to further street improvements.
