CLOSED SESSION REPORT Assistant City Attorney Albert Maldonado stated there was reportable action on two Closed Session items: Item A) Daniel Felix v. Andrew Saibene, et al., United States District Court Case No. 5:24­cv­01494: The City Council voted to approve a settlement in the amount of $1,800,000. The motion was made by Council Member Sanchez and seconded by Council Member Shorett; Approved 5-1 with Council Member Ortiz voting in opposition and Council Member Ibarra absent. Item B) The City Council voted unanimously (6-0, Ibarra absent) to initiate litigation in two receivership cases. The motion was made by Council Member Shorett and seconded by Council Member Sanchez. The details regarding those cases will be available to the public once the cases are filed. PRESENTATIONS 1. Development Permit Type D 23­19 (Adaptive Reuse) To Convert Existing Commercial Office Space Into Four Residential Units (Ward 1) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California, adopt Resolution No. 2025-324, approving Regular Meeting Minutes July 16, 2025 Mayor and City Council of the City of San Bernardino Page 4 Development Permit Type-D 23-19, allowing the conversion of an existing commercial office building containing approximately 2,430 square feet into four (4) residential units containing 607.50 square feet each, and the construction of new 819 square-foot covered parking area; and finding the project subject to a Categorical Exemption under the California Environmental Quality Act. Mayor Tran opened the Public Hearing at 5:37 p.m. Senior Planner Mike Rosales provided a presentation. There were three public comments; Jim Mulvihill, Keith Benitez, and Ron Alvarado all spoke in favor of this item. Mayor Tran closed the Public Hearing at 6:09 p.m. The Public Hearing was re-opened at 6:10 p.m. for the Mayor and City Council to address questions to the developer of the property. Public Hearing And Resolution Confirming Assessments For Delinquent Solid Waste Collection Service Charges On The Property Tax Roll For Fiscal Year 2025­26 (All Wards) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California adopt Resolution No. 2025-327, authorizing the Mayor and City Council of the City of San Bernardino, California, to adopt the report proposing to have delinquent solid waste collection service charges collected on the tax roll. Mayor Tran opened the Public Hearing at 6:23 p.m. Public Works Director Lynn Merrill provided a presentation. There were no public comments. Interim City Manager Bill Gallardo announced that this item was pulled from the agenda and would be heard at the August 6, 2025 regular meeting. Assistant City Attorney Albert Maldonado clarified that the item was being continued, rather than pulled from the agenda. Council Member Ortiz made the motion to continue to the item to the August 6, 2025 regular meeting. Council Member Shorett left the dais before the vote was taken. Highlights included Little League World Series Western Regionals, General Plan Element updates, and “National Night Out” on August 5th. PUBLIC COMMENTS FOR ITEMS LISTED AND NOT LISTED ON THE AGENDA Erick Marquez thanked Bill Gallardo for his service, questioned why meeting minutes from 2023 were on the agenda, and shared other non-meeting related anecdotes. Sharon Negrete expressed concerns about the Midwest Veterinary Supply agreement and urged the city to use local companies. Regular Meeting Minutes July 16, 2025 Mayor and City Council of the City of San Bernardino Page 8 Luis Ojeda thanked Bill Gallardo for his service, expressed concerns about the city manager turnover rate, and stated that San Bernardino has potential but is not taking advantage of its assets. Al Palazzo suggested developing housing near Metrolink stations, proposed repurposing underused properties for community development, and expressed frustration about being unheard despite long-term advocacy. Joe Salas spoke about the opportunity to build a stronger culture with the new City Manager and suggested prioritizing economic development while also supporting services for the unhoused. Lydia Savala supported the mobile vet clinic and emphasized the city’s obligation, based on a donation, to provide spay and neuter services. Lynne Wear highlighted the Neighborhood Association Council’s achievements, its focus on community relationships, and the value of respect and collaboration. Gregory Taylor expressed frustration with homelessness. Steve Portias objected to changing the “Route 66” event date, citing conflicts with another event and concerns from classic car owners. Zazette Scott spoke about community safety concerns and human trafficking. Jim Smith praised the council for progress on homelessness and city improvements, mentioned an upcoming Charter Review Committee meeting, and expressed optimism about future initiatives. Dolores Armstead thanked Parks and Recreation for their programs, expressed concerns about the Oxbow site, requested a centralized city hall, and suggested improvements to zoning practices. Emed Loket introduced himself as a field representative for Assemblymember Robert Garcia and stated that he is the new point of contact for the City in District 50. Stephanie Liggins thanked the council for funding a tree-planting project and expressed excitement about improving her street. Miriam Nieto shared plans for a State designation for the “E Street corridor” as an arts and culture district and encouraged collaboration on the project. Ronnika Ngalande addressed prior allegations made against her during a planning commission meeting, stated that her complaint was substantiated, and thanked the Neighborhood Association Council for their support and action. Authorizing the City Manager to execute Amendment No. 2 to the Contract with Midwest Veterinary Supply, increasing the annual not to exceed amount to $500,000 and extending the contract expiration date to June 30, 2026. Council Member Ortiz pulled this item for a separate vote. There was discussion about the RFP process and how Animal Services Department Grants are being expended.
