There were no public comments or requests to speak for Closed Session.
Prior to convening to Closed Session, Assistant City Attorney Albert Maldonado stated
that as in recent previous meetings, one of the items of Anticipated Litigation involved
ongoing issues between the City and Mandeville Modular.
He also noted that the originally posted Agenda identified Item A)i) as “Mark” Brown v.
City of San Bernardino, but the correct name is “Matthew” Brown v. City of San
Bernardino. A revised agenda had been posted online. Maldonado clarified that since
the case number was correct and the error not substantive, the item could still proceed.

INVOCATION AND PLEDGE OF ALLEGIANCE
Deacon Nelson Glass from Our Lady of the Assumption Church led the invocation, and
Vernae Palmer from Lankershim Elementary School led the Pledge of Allegiance to the
Flag.
CLOSED SESSION REPORT
Assistant City Attorney Maldonado reported that there was a unanimous vote to
approve a settlement in the matter of Item A)ii) on the Closed Session Agenda
(Ricardo Paniagua v. City of San Bernardino, et al.). The motion was made by Council
Member Shorett and Seconded by Council Member Sanchez.
Regarding Item C), there was a motion made by Council Member Sanchez, seconded
by Council Member Shorett, to appoint Acting City Clerk Telicia Lopez to the City Clerk
position. The motion passed 6-2, with Council Member Ortiz and Mayor Tran voting in
opposition. The appointment will be finalized upon approval of a contract presented at
the October 1, 2025 Regular Mayor and City Council Meeting.
PRESENTATIONS
1. Citizen(s) of the Month – The Essential Barber Club
Council Member Sanchez presented the certificate to Stevie Valencia, Jr. Mr. Valencia
thanked the Mayor and City Council for the recognition.
2. Proclamation for Hispanic Heritage Month – September 15 – October 15, 2025
(All Wards)
The Mayor and City Council presented the certificate to members of the Hispanic
Chamber of Commerce.
3. Proclamation for California Native American Day in the City of San Bernardino
– September 26, 2025 (All Wards)
The Mayor and City Council presented the proclamation to Assembly Member James
Ramos.
PUBLIC HEARING
4. Continuation, September 17, 2025, of Public Hearing to Adopt Resolution
Denying or Approving Appeal 2406 of Planning Commission's Approval of
Resolution 2024034 PC that Restored the Conditions of Approval for
Administrative Development Permit 22020 (Ward 3)
Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California,
1. Adopt Resolution No. 2025-352 of the Mayor and City Council of the City
of San Bernardino, California denying Appeal 24-06 of Appeal 24-05, thereby upholding the Planning Commission’s approval of Appeal 24-05, which restored the deleted conditions of approval 20 (twenty) through 26 (twenty-six) that were redacted within the Community Development and Housing Departments approval of Amendment to Conditions of Approval 23-01 for Administrative

Mayor Tran opened the quasi-judicial Public Hearing at 5:30 p.m.
Acting City Clerk Telicia Lopez administered the Oath of Allegiance to the public commenter and the appellants.
Mayor Pro-Tem Figueroa announced that he received a call from one of the appellants approximately two years ago. He reported that he did not speak to them regarding the matter but instead referred them to staff.
Director of Community Development and Housing Gabriel Elliott provided a synopsis of the background of this item.
Kendra Carney Mehr, attorney for ADESA International, spoke in favor of Recommendation No. 2, approving Appeal No. 24-06. Mohammed Ghods, attorney for Waterman Business Center Association, argued in favor of Recommendation No. 1, denying Appeal No. 24-06.
There was one public comment:
Dolores Armstead spoke in support of recommendation No. 1, adopting Resolution No. 2025-352 denying Appeal 24-06.
Mayor Tran closed the Public Hearing at 6:43 p.m.
Council Member Sanchez made a motion to approve Staff Recommendation No. 2. There was no second to the motion.
Council Member Ortiz made a substitute motion to approve Recommendation No. 1. She then asked staff if the Mayor and City Council could direct the appellants to continue negotiations before a decision is made.
City Manager Eric Levitt announced that he had discussed that option with the City Attorney, and that the Mayor and City Council did have the option to close the Public Hearing and direct the appellants to attempt to come to an agreement on this issue.
After hearing staff’s presentation, testimony and rebuttals from both appellants, and the City Manager’s opinion, the Mayor and City Council came to a consensus that this

matter was primarily civil, and the City should not have been involved in the dispute. They ultimately directed both parties to re-attempt negotiations in order to reach an agreement. Council Ibarra made the motion, seconded by Council Member Knaus.

FOR 45 DAYS TO ALLOW THE APPELLANTS TIME TO REACH

5. Approval of the Draft Fiscal Year 20242025 Consolidated Annual Performance
and Evaluation Report (CAPER) to the US Department of Housing and
Urban Development (All Wards) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California:
1. Conduct a public hearing on the draft Fiscal Year 2024-2025
Consolidated Annual Performance and Evaluation Report; and
2. Authorize its submission to the United States Department of
Housing and Urban Development; and
3. Authorize the City Manager or designee to take any further actions
and execute any additional documents necessary to effectuate the
submission of the Fiscal Year 2024-2025 Consolidated Annual
Performance and Evaluation Report.
Mayor Tran opened the Public Hearing at 7:02 p.m.
Housing Division Manager Trina Perez provided a brief summary of the report.
There were two public comments:
Alisha Nash spoke about homelessness prevention efforts. She also spoke about
“slumlords” in the City and advised that they should not be receiving any federal
funding.
Ashley Dial echoed the previous commenter’s sentiments. She asked the Mayor and
City Council to take action against deficient landlords.
The Public Hearing was closed at approximately 7:15 p.m.

CITY MANAGER UPDATE
At this time, City Manager Eric Levitt provided updates to the community. Highlights
includes the City receiving a “Clean California” designation, homeless encampment team
activities, and celebration of the Feldheym Library’s 40th Anniversary.
PUBLIC COMMENTS FOR ITEMS LISTED AND NOT LISTED ON THE AGENDA
Al Palazzo reflected on ideas he has for the City and said he could bring improvements
if he were Community and Economic Development Director.
Mike Hartley said the City’s culture and mindset must change for people to want to
come to San Bernardino and expressed concern about possible campaign donations
from PAMA management to Council Members.
Christian Shaughnessy expressed support for Item No. 13 and Item No. 19.
Kim Calvin criticized Council Members for past decisions about City Managers and the
navigation center, and said those responsible should not seek re-election.
Luis Ojeda described safety concerns at a local shopping center and spoke about the
persistence of homelessness despite city spending.
Erick Marquez delivered comments in Spanish directed at a Council Member. (Mr.
Marquez chose not to have his comments interpreted by the on-site interpreter.)
Georgia L. urged installation of cameras at the animal shelter, criticized city priorities,
and questioned council candidates’ performance on homelessness and downtown
development.
Jim Smith announced a presentation by Native Sons of the Golden West and
emphasized the importance of preserving San Bernardino’s history.
Ronnika Ngalande spoke about concerns over division and lack of trust in the City and
called for transparency, integrity, and collaboration to rebuild the community.
John Schollenberger raised concerns about campaign donations, transparency
regarding the “Oxbow” project, and statements made by commissioners and City
officials.
Ron Alvarado called for unity across wards and spoke in favor of Item. No. 11.
Harry Hatch raised concerns about fireworks ordinances not being enforced, and
suggested using standard court citations instead of administrative fees.

Robert Carrillo encouraged the city to support Hispanic entrepreneurs and noted issues
with planning department delays that hinder development.
Esther Gonzalez discussed homelessness, tenant rights, and affordable housing
concerns, and urged the City to enforce accountability among landlords.
Ruben Mendoza spoke about affordable housing models in the City of Vienna, shared
ideas about zoning protections and rent control, and encouraged long-term planning to
address housing issues.
CONSENT CALENDAR
Items on the Consent Calendar are considered routine and are voted on in a single
motion unless a council or staff member has pulled the item for more discussion.
Prior to hearing the Consent Calendar, Assistant Attorney Maldonado announced that
Council Members do not have to recuse themselves from a Consent Calendar item
unless it is pulled for a separate vote or discussion.

Commission to provide City sewer services to a property located at
2326 Portola Street, San Bernardino, California, within the
unincorporated community of San Bernardino County; and
2. Authorizing the City Manager to execute an Irrevocable Agreement

12. Authorize the City Manager to Execute Amendment No.1 to the Law
Enforcement Services Agreement with the San Bernardino International
Airport Authority (All Wards)
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California, authorize the City Manager to execute the proposed First
Amendment to the Law Enforcement Services Agreement between the City of
San Bernardino and the San Bernardino International Airport Authority.

13. Acceptance of Yuhaaviatam of San Manuel Nation Grant Award
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California (“City”) adopt Resolution No. 2025-370 authorizing:
1. The acceptance of the Yuhaaviatam of San Manuel Nation Grant
Award; and
2. The amendment of the Fiscal Year 2025/2026 adopted Budget in both
revenue and expenditures by $200,000.
Council Member Ortiz pulled this item for further discussion. Council Members
Shorett, Sanchez, Knaus initially recused themselves from this item due to a conflict
of interest for receiving campaign contributions from San Manuel.
Council Member Ortiz asked Police Chief Goodman if this would be an ongoing
grant. Chief Goodman stated that this was a one-time grant, and future expenses
would be covered by the department’s budget.
The initial motion to adopt the resolution was approved, however upon return of the
recused Council Members to the dais, Council Member Sanchez asked if the Mayor
should have recused herself as well since she also received donations from San
Manuel. City Attorney Maldonado confirmed that per the Levine act, members
should recuse themselves even if they do not vote on the item. The Mayor then cited
her conflict of interest due to receiving campaign contributions from San Manuel.
Council Members Shorett, Sanchez, Knaus and Mayor Tran then left the dais again
so the item could be voted upon once more.

14. Approve Amendment No. 2 to the Agreement with Z & K Consultants,
Inc. for Nicholson Park Construction Management and Construction
Inspection Services for $167,156.21 for a total amount not to exceed $844,794
(Ward 6)
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California:
1. Approve Amendment No. 2 to the Professional Services Agreement
with Z & K Consultants, Inc. in the amount of $167,156.21 for the
Construction Management and Construction Inspection Services for
Nicholson Park Improvements, increasing the not to exceed
amount to $844,794 (Project); and
2. Authorize the City Manager or designee to execute all documents
with Z & K Consultants, Inc.; and
3. Authorize the City Manager or designee to expend the contingency
fund, if necessary, to complete the project.
Council Member Flores announced that he would abstain from this item, due to
residing within 500 feet of the project. Council Member Flores remained at the
dais during the vote, and his abstention was noted.

Inspection Services in Support of the City’s Capital Improvement
Program and Land Development for a total amount not to exceed
$450,000 (All Wards)
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California:
1. Approve Task Order No. 2026-001 with Infrastructure Engineers, A
Bowman Company, in the amount of $250,000 for inspection services
in support of the City’s Capital Improvement Program (CIP); and
2. Approve Task Order No. 2026-002 with Infrastructure Engineers, A
Bowman Company, in the amount of $200,000 for inspection services
in support of the Land Development Division; and
3. Authorize the City Manager, or designee, to execute both task orders
and any related documents necessary to implement these services,
consistent with the terms of the existing Professional Services
Agreement with Infrastructure Engineers.

1. Authorizing the City Manager to Execute the Memorandum of
Understanding (MOU) with the San Bernardino Municipal Water
Department (SBMWD) for the lease of Water Department Property at 333
Chandler Place; and
2. Authorizing the Director of Finance and Management Services to amend
the FY 2025/26 Animal Shelter operating budget in the amount of
$66,696.00 for the lease of Water Department Property at 333 Chandler
Place.
