City Manager 7:00 PM The Regular Meeting was called to order at 7:03 PM by Mayor Helen Tran on Wednesday, August 16, 2023, at Feldheym Central Library, San Bernardino, CA. INVOCATION AND PLEDGE OF ALLEGIANCE Pastor James Grant from Soldier for Christ Church led the Invocation and Melanie Delgadillo from Arroyo Valley High School led the Pledge of Allegiance to the Flag. CLOSED SESSION REPORT City Attorney Sonia Carvalho reported that there was reportable action from Closed Session. The City Council approved a settlement of $325,000.00 for item No. A(ii) Blanca Gamez v. Jonathan Palmer, et al., in a unanimous vote of all members present. PRESENTATIONS 1. Proclamation for California Native American Day in the City of San Bernardino – September 22, 2023 (All Wards) Mayor Tran presented the Proclamation to Vanessa Brierty, District Director to Assembly Member Ramos, and Jack Lugo, Morongo Band of Mission Indians. 3. Proclamation for International Overdose Awareness Day in the City of San Bernardino – August 31, 2023 (All Wards) Mayor Tran presented the Proclamation to James Dettman, Varp, Inc. Manager of Business Development. 2. Demand Management Incentive Program Check Presentation: San Bernardino Valley Municipal Water Department (Valley District) (All Wards) The Mayor and City Council members accepted the check from the members of the San Bernardino Municipal Water District and the San Bernardino Valley Municipal Water District. APPOINTMENTS 5. Library Board Appointment of James C. Pierson City Clerk Rocha administered the Oath of Office to Mr. Pierson. Mayor Tran presented the appointee with a Certificate. Highlights included a new fire station on Del Rosa Avenue, San Bernardino Youth Civic Engagement Council, San Bernardino Symphony Concert "A Night to Remember”, August is designated for adopting pets at a reduced fee of $25, City Hall Selfie Day, and Parks and Recreation Community Service Director, Lydie Gutfeld received an award from Cal State San Bernardino for her efforts in preparing Fisc alini Field for the NCAA Division II Regional Championships. PUBLIC COMMENTS FOR ITEMS LISTED AND NOT LISTED ON THE AGENDA Veronica Munoz thanked Parks and Recreation and Public Works for their efforts to maintain park safety and raised concerns about safety issues at Tom Go uld Memorial Park following the temporary closure of Wildwood Park. Pastor William Rick described the challenges tenants were experiencing during the ongoing eviction-related litigation. Daryl Wilson shared his experience of being displaced and conveyed frustration with the legal process. Al Palazzo offered to contribute development expertise and a long-term vision to the city without the need for paid compensation. Rikke Van Johnson promoted an upcoming event with Deputy Rayford Owens, thanked Councilmember Calvin for her work, and highlighted a street -renaming issue that required clarification. Bishop Charles Tyler expressed concern over complaints related to his RV and asked for guidance on how to address the matter. Keith Carson spoke about the distress and uncertainty tenants at 340 West 4th Street were feeling due to their expected displacement. Regular Meeting Draft Minutes August 16, 2023 Mayor and City Council of the City of San Bernardino Page 4 In response, Interim City Manager McNeely commented that social service agencies had been assisting residents with relocation resources and urged them to share their contact details with staff for continued support. Mayor Tran paused Public Comments at 8:00 p.m. to move on to the Public Hearing, item No. 26. PUBLIC HEARING 26. Proposed Substantial Amendment to Fiscal Year 2020-2021 Annual Action Plan Associated with Community Development Block Grant Coronavirus Relief Funds (All Wards) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California: 1. Conduct a second Public Hearing to obtain citizens’ comments on the proposed Substantial Amendment to Fiscal Year 2020-2021 Annual Action Plan for the Community Development Block Grant Coronavirus Relief Funds; and 2. Approve the Substantial Amendment to Fiscal Year 2020-2021 Annual Action Plan for the Community Development Block Grant Coronavirus Relief Funds; and 3. Approve the termination of the Community Development Block Grant Coronavirus Subrecipient Agree ment between the City of San Bernardino and the Housing Authority of the County of San Bernardino; and 4. Authorize the City Manager or designee to take any further actions and execute any further agreements or documents as necessary to effectuate the submittal of the Proposed Substantial Amendment to Fiscal Year 2020-2021 Annual Action Plan. Mayor Tran opened the public hearing at 8:00 p.m. A presentation was provided by Deputy Director of Housing, Cassandra Searcy. There were no public speakers for this hearing. Discussion ensued on this item regarding the amount of funding that would be lost and how the funds could be reallocated. Deputy Director Searcy advised the unspent funds from various designated programs which include Eviction Prevention, $340,000 ; Senior Nutrition Program $9,746; $17,476 for PPE cleaning supplies, CDBG CV1 Administrative Funds, $400,706, and CDBG CV3, $336,209 in administrative funds remained specifically for coronavirus-related purposes. In addition, she advised that funds were being reallocated to be used as allowable for the grant. The amounts reported were reflected in the staff report. PUBLIC COMMENTS FOR ITEMS LISTED AND NOT LISTED ON THE AGENDA Tyler Durden spoke about the victims and survivors of Maui, emphasizing that relying on government or police assistance was not a viable plan. Terry Boykins, Executive Director of Project Fighting Chance, acknowledged the city’s support for community programs, highlighting successful summer activities for at-risk youth. James Albert commented on a storm drain project, expressing concern that collaboration with the county’s Flood Control District would waste opportunities to capture stormwater for reuse. Robert Porter, member of The Arts and Historical Preservation Commission, encouraged local artists to apply for new grants and emphasized the need for better support for homeless individuals in the community, including more Code Enforcement Officers to improve city conditions. Paige Miller praised Police Chief Goodman for efforts to enhance community safety, while expressing opposition to a state bill perceived as detrimental to law enforcement. John Schollenberger spoke on the upcoming elections, urging transparency and fairness. Georgia Lykouretzos raised concerns about animal shelter conditions, calling for accountability regarding shelter resources. Dolores Armstead expressed gratitude toward Interim City Manager McNeely for managing council items effectively and hoped the city would find a new city manager with similar intelligence and dedication. Treasure Ortiz criticized the city for entering an agreement with the American Civil Liberties Union regarding police actions towards the homeless. Robert Soberianis, a resident, shared his perspective on poor living conditions at 340 W 4th Street, urging council members to understand the situation firsthand. Leila Gomolka, president of the North Park Neighborhood Association, spoke on the successful community cleanup initiative, and the need for ongoing maintenance support from the city. Les highlighted the issue of a slum landlord on 4th Street, criticizing the lack of accountability and the poor living conditions in the building. Tim Prince, a lifelong resident and attorney, defended the American Civil Liberties Union against criticism and emphasized its role in upholding constitutional rights. If awarded funding, authorize the Agency Director of Administrative Services to appropriate up to $500,000 in revenues and expenditures for eligible project activities through the CRC Planning Program Grant. Increase the Library Department authorized staffing by two full-time positions, one Assistant Literacy Program Coordinator and one Library Assistant for FY 2023/24. Council Member Ibarra pulled the item to request that staff continue the item until concerns raised during Public Comments regarding the water going to the Ocean could be addressed. Deputy Director of Public Works Susan Pan advised that the water would not leave the region and would be diverted to a County of San Bernardino water detention basin. Amendment No. 4 to Agreement with ERSC for State Street Extension (Ward 6) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California, authorize the City Manager to execute Amendment No. 4 to the Professional Engineering Services Agreement with Engineering Resources of Southern California (ERSC), adding engineering and construction support services in the amount of $83,485 and increasing the purchase order to a total amount not-to-exceed of $349,995 for the State Street extension from Baseline Street to 16th Street. Council Member Calvin commented on issues raised during public comments by former 6th Ward Councilman Rikke Johnson. She advised that the street needs to be renamed to University Parkway and wanted a report back from staff on how the renaming will be addressed. Review and consider the proposed revisions to the Naming and Renaming of City Parks, Recreational Facilities, and Amenities Policy; and 2. Adopt Resolution No. 2023-134 as presented, repealing Resolution No. 2010-342 and adopting the revised policy; OR 3. Provide direction for modifications to the proposed policy. Council Member Sanchez requested that staff remove section B of the selection criteria policy requiring the individual to live, work, or serve in a San Bernardino service organization. Proclaiming the need to prioritize nuisance and building and safety abatement costs and authorizing the City Manager to approve various code enforcement and Health and Safety Code assistance to displaced individuals’ expenses related thereto; 2. Approving the appropriation in the amount of $500,000 in American Rescue Plan Act (ARPA) funds related to various nuisance and property abatement costs and assistance to displaced individuals; 3. Authorizing the Agency Director of Administrative Services, or designee, to amend the City of San Bernardino’s FY 23/24 Operating Budget by $500,000.
