HomeMy WebLinkAboutItem No. 23 - 2025 ADU Legislative UpdateDevelopment Code Amendment 25-10 2025 Accessory Dwelling Unit Legislative Update Presented by George Velarde, Associate Planner Community Development and Housing Department Item No. 23 Background: May 2021 – MC-1559 adopted, establishing standards for Accessory Dwelling Units in compliance with Government Code December 2022 – MC-1604 adopted, updating standards for Accessory Dwelling Units in compliance with SB 897 January 2025 – MC-1645 adopted, provided updated definitions, expanded the prohibition on parking and increased the allowable number of detached accessory dwelling units on a multi-family lot Significant Changes: AB 1154  JADU owner-occupancy Prohibition on short-term rentals Significant Changes: SB 543 Provide update to California Department of Housing and Community Development (HCD) within 60 days of adoption. If not provided, the City’s own ADU ordinances becomes null and void. Clarified definitions and clean up language Development Impact Fees (DIFS) and school fees Next Steps:  Any local ordinance that is not in compliance with AB 1154 and SB 543 on January 1, 2026, will be found null and void in its entirety.  Urgency ordinance will take effect immediately upon adoption.  Re-adoption of ordinance will be brought back for first reading on January 7, 2026 Recommendation: Adopt Urgency Ordinance of the Mayor and City Council of the City of San Bernardino, California, approving Development Code Amendment 25-10; and finding such action statutorily exempt from the California Environmental Quality Act under Public Resources Code Section 21080.17 (Attachment 1 and Attachment 2); and Introduce for first reading, read by title only, and waive further reading of Ordinance of the Mayor and City Council of the City of San Bernardino, California, approving Development Code Amendment 25-10; and finding such action statutorily exempt from the California Environmental Quality Act under Public Resources Code Section 21080.17; and Schedule the adoption of the Ordinance to the regularly scheduled meeting of the Mayor and City Council on January 7th, 2026.
