2. General Plan Amendment 25-03, Introduce Ordinance No. MC-1657
Adding Section 10.24.195 to the San Bernardino Municipal Code adopting
Citywide Truck Routes, and direct staff to comply with AB98 Warehouse
Design and Build Standards (All Wards)
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino:
1. Adopt Resolution No. 2025-393 of the Mayor and City Council of the
City of San Bernardino, California, adopting a Categorical
Exemption under the California Environmental Quality Act
Section 15301(c), and approving General Plan Amendment 25-
03 to amend the Circulation Element to add Citywide Truck Routes
Option A pursuant to Assembly Bill 98 (AB 98), (Attachment 1A).

2. Adopt Resolution No. 2025-394 of the Mayor and City Council of the
City of San Bernardino, California, adopting a Categorical
Exemption under the California Environmental Quality Act
Section 15301(c), and approving General Plan Amendment 25-

1. San Bernardino International Airport Authority (SBIAA) Presentation (All Wards)
Chief Executive Officer Michael Burrows from the San Bernardino International Airport
gave the presentation to the Mayor and City Council.
At this time, the regular agenda was resumed.
CITY MANAGER UPDATE
City Manager Eric Levitt provided the City Manager Update.
PUBLIC COMMENTS FOR ITEMS LISTED AND NOT LISTED ON THE AGENDA
At this time, public comments were heard.
Prior to hearing the Consent Calendar, City Manager Levitt announced that staff would be
pulling Item No. 11 and Item No. 14, bringing them back at the December 17th meeting.
CONSENT CALENDAR
Items on the Consent Calendar are considered routine and are voted on in a single
motion unless a council or staff member has pulled the item for more discussion.
Prior to taking the Consent Calendar vote, Council Members Sanchez, Shorett, and
Mayor Tran, all recused themselves from Item No. 6 due to a Levine Act financial
conflict for receiving campaign contributions from San Manuel.

Recommendation:
It is recommended that the Mayor and City Council of the City of San
Bernardino adopt Resolution No. 2025-396, approving the Citywide Cost Allocation
Plan (CAP) and OMB Compliant Indirect Cost Plan prepared by Matrix Consulting
Group, based on the City’s Fiscal Year 2022/23 adopted budget, and authorizing
its use for the following purposes:
1. Recovering indirect costs associated with state and federal
grants, consistent with the requirements of 2 CFR Part 200; and
2. Establishing a fair and transparent method for allocating
Citywide administrative expenses and charging intergovernmental and
regional partners for shared services.

1. Authorize the City Manager to execute a Professional Services
Agreement with Forensiclean LLC to provide crime scene clean up
services for a term beginning December 3, 2025, through June 30,
2028, with an option to extend for two additional years; and
2. Authorize total expenditures not to exceed $225,000, which includes
$135,000 for the initial term and up to $90,000 for the optional two-year
extension, if exercised by the City.

Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California, adopt Resolution No. 2025-397, authorizing the Director of Finance &
Management Services to amend the Fiscal Year 2025/26 Operating Budget to
increase grant funded expenditures by $204,240.27 to reflect funding available in
the Citizens’ Option for Public Safety Program.

It is recommended that the Mayor and City Council of the City of San Bernardino,
California;
1. Approve the award of a Professional Design Services Agreement
with IDS Group, Inc. in the amount of $140,633 for the City Hall
Parking Structure (5 Level) Improvements Project; and
2. Authorize a contingency amount in total of $9,367 for the project,
bringing the total project budget to $150,000; and
3. Authorize the City Manager or designee to execute all documents
with IDS Group; and
4. Authorize the City Manager or designee to expend the
contingency fund, if necessary, to complete the project.

12. Accept Bridge Investment Program (BIP) Planning Grant for the
Bridge Rehabilitation Planning Project in the Amount of $676,348 (Wards 2, 4,
and 5)
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California:
1. Adopt Resolution No. 2025-398 accepting the Bridge Investment
Program (BIP) Planning Grant for the Bridge Rehabilitation Planning
Project in the amount of $676,348; and
2. Authorize the City Manager or designee to execute the grant agreement
and all related documents in the total project amount of $845,435; and
3. Authorize the Director of Finance & Management Services to amend the
FY 2025/2026 budget by recognizing $676,348 in federal grant revenue
and appropriating the same amount in project expenditures for the
Bridge Rehabilitation Planning Project; and
4. Authorize the Director of Finance & Management Services to appropriate
$169,087 from the Local Regional Circulation Fund to satisfy the
required 20% local match; and
5. Authorize the Director of Finance & Management Services to amend the
FY 2025/2026 Capital Improvements Program to add the Bridge
Rehabilitation Planning Project in the total amount of $845,435.

Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California:
1. Approve Amendment No. 1 to the Maintenance Services Agreement with West Coast Arborists, Inc. to extend the term of the agreement from June 30, 2025, to June 30, 2026; and to update the not-to-exceed amount to $6,134,604.90, in order to reflect total cumulative spending and anticipated needs for the full contract term, consistent with the compensation provisions of the Original Agreement; and
2. Authorize the City Manager to execute all documents necessary to increase the contract amount by the council approved one-time allocation

of $500,000 for tree stump removals; and
3. Authorize the City Manager to execute all related documents necessary to
effectuate these amendments.
4. Authorize the Interim Director of Finance and Management Services to issue a purchase order for West Coast Arborists for $1,700,000.00 for fiscal year 2025-2026.

It is recommended that the Mayor and City Council of the City of San Bernardino,
California;
1. Approve the award of a Construction Agreement with J B Bostick
LLC, in the amount of $131,200 for the Villasenor Library -
Parking Lot Surfacing (Project); and
2. Authorize the construction contingencies, construction
management, and administrative costs in the total amount of
$68,800 for the Project, bringing the total Project budget to
$200,000; and
3. Authorize the City Manager or designee to execute all documents
with J B Bostick LLC; and
4. Authorize the City Manager or designee to expend the
contingency fund, if necessary, to complete the Project.

15. Approval of Task Order No. 2026-001 with Hilltop Geotechnical Inc. for
Annual On-Call Geotechnical and Construction Material Testing Services
to Support the Capital Improvement Program (CIP) Projects (All Wards)
Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California:
1. Authorize Task Order No. 2026-001 with Hilltop Geotechnical Inc. in the
amount not to exceed $300,000 for on-call geotechnical investigation
and construction material testing services to support various
Capital Improvement Program (CIP) projects through June 30, 2026;
and
2. Authorize the City Manager or designee to execute the task order and
any related documents necessary to implement these services,
consistent with the terms of the existing On-Call Professional Services
Agreement with Hilltop Geotechnical Inc.

California:
1. Approve Amendment No. 2 to the Professional Design
Services Agreement with RHA Landscape Architects – Planners
Inc. for the Seccombe Lake Park Revitalization Project (Project),
extending the term of the agreement to June 30, 2027; and
2. Authorize the City Manager or designee to execute all documents
with RHA Landscape Architects – Planners Inc.

the Amount of $78,700 with a $28,100 Contingency (Ward 1)
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California:
1. Approve Amendment No.1 to the Design Services Agreement with
Bell Design Group in the amount of $78,700 for the Norman F.
Feldheym Public Library Improvement Project (Project), increasing
the not to exceed amount to $397,700; and
2. Authorize additional contingencies for unforeseen conditions in the
total amount of $28,100; and
3. Authorize the City Manager or designee to execute all documents
with Bell Design Group; and
4. Authorize the City Manager or designee to expend the contingency
fund, if necessary, to complete the project.

18. Approval of Amendment No. 1 to the Maintenance Services Agreement with
the Center for Employment Opportunities for Right -of -Way Clean -Up
and Weed Abatement Services (All Wards)
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California:
1. Approve Amendment No. 1 to the Maintenance Services Agreement
with the Center for Employment Opportunities Inc. (CEO) increasing the
not-to-exceed amount from $1,014,340 to $6,086,040 to reflect the
cumulative contract value for the full six-year term; and
2. Authorize the City Manager or designee to execute all related documents
necessary to effectuate this Amendment.

19. Adopt Resolution Approving Final Tract Map No. 16794 (Ward 5)
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California, adopt Resolution No. 2025-399, approving Final Tract Map No. 16794
(Subdivision 06-31) involving the subdivision of a parcel (APN 0261-011-08, 13,
and 14) containing 18.45 acres into forty-three (43) single family residential lots
and one (1) debris basin located on the west side of N. Palm Avenue,
approximately 200 feet north of W. Verdemont Drive within the residential low
(RL) zone, accepting the public dedications as set forth on said map; and
authorizing execution of the standard form of agreement for the subdivision
improvements.
Council Member Ortiz pulled the item for further discussion. She discussed the
subdivision map’s impending expiration and longstanding community concerns.
Director Elliott reported no environmental or project changes since the original approval,
so no new review was required.
Deputy City Attorney Maldonado stated the developer had vested rights and could not be
forced to restart without legal risk.
Council Member Knaus clarified that the Oxbow debris issue was separate and
highlighted the need for new housing and the developer’s positive track record.

California: Adopt Ordinance No. MC-1656 amending Section 8.24.100 of Chapter
8.24 of Title 8 of the San Bernardino Municipal Code, relating to the Construction
and Demolition Debris Recycling Program (All Wards).

DISCUSSION
21. Discussion for a Potential One-Year Moratorium on the Sale and Use of
Fireworks Within the City of San Bernardino and/or Additional Strategies to
Enhance the City’s Enforcement to Reduce the Use of Illegal Fireworks (All
Wards)
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California, discuss several options which include a social host ordinance and
drone enforcement program, a potential one-year moratorium on the sale and
use of fireworks, and/or maintaining the current safe and sane fireworks
ordinance with regulatory fee, and to provide direction to staff regarding the next
steps, if any.
Senior Management Analyst William Lampi gave a presentation to the Mayor and City
Council.
Council Member Sanchez made a motion to receive and file the report and direct
staff to look into a social host ordinance and drone enforcement program. Council
Member Knaus seconded the motion.
Council Member Ortiz made a substitute motion to approve staff’s recommendation.
Mayor Pro-Tem Figueroa seconded the motion. The motion failed 2-4 with Council
Members Sanchez, Shorett, Knaus, and Flores voting in opposition.
Council voted on the original motion made by Council Member Sanchez and
seconded by Council Member Knaus.

Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino
adopt Urgency Ordinance No. MC-1658U of the Mayor and City Council of the
City of San Bernardino, California, approving Development Code Amendment 25-
10 amending Chapter 19.04 (Residential Zones); Section 19.04.030(2)(P)
(Residential Zones Specific Standards - Accessory Dwelling Units) of the City of
San Bernardino Development Code (SBMC Title 19) to update the
development standards for Accessory Dwelling Units and Junior Accessory
Dwelling Units in compliance with recent changes in state law;, and finding such
action statutorily exempt from the California Environmental Quality Act under
Public Resources Code Section 21080.1
There was a consensus from the Mayor and City Council to waive the presentation.

24. Pavement Management Program (PMP Findings and Funding Scenarios)

Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino
California:
1. Receive and file the Pavement Management Program (PMP) draft
report update; and
2. Provide direction on neighborhood rehabilitation focused areas and
funding strategies; and
3. Direct staff to incorporate the PMP findings and recommendations into
the FY 2026–2036 Capital Improvement Program (CIP); and
4. Authorize staff to evaluate and pursue sustainable funding strategies,
including potential bond financing, Measure S allocations, and available
state and federal grant opportunities.
