CLOSED SESSION PUBLIC COMMENT
Timothy Prince addressed the council to assert that Treasure Ortiz's claim is not frivolous,
criticized repeated closed-session discussions, expressed belief of a potential conflict of
interest regarding council member contributions from parties involved in the case.
John Sholenberger highlighted Chief Goodman and Lieutenant Loera’s texts and actions
suggesting potential misconduct, questioned the city’s investigation, and raised concerns
about conflicts of interest involving council members.
Victor Suarez questioned the circumstances of Lieutenant Jose Loera’s apology and
direction by Chief Goodman regarding alleged misconduct, highlighted Loa’s subsequent
claim against the city, and raised concerns about potential conflicts of interest for council
members with ties to the Police Officers Association
Luis Ojeda praised Chief Goodman and the police department for recent achievements
and community improvements, urged the council and public to focus on verified facts
Christian Shaughnessy criticized Councilwoman Sandra Ibarra for failing to investigate
alleged illegal access of the CLETS system, accused her of prioritizing personal attacks
over city oversight.
Prior to convening in Closed Session, Deputy City Attorney Albert Maldonado announced
that Item B was regarding Mandeville.
Council Member Ortiz announced that she would be recusing herself from Item C (i) and
(ii) of Closed Session, due to being the subject of the claim.

called to order at 5:12 PM by Mayor Tran on Wednesday, February 18, 2026, at
Feldheym Central Library, San Bernardino, CA.

CLOSED SESSION REPORT
Deputy City Attorney Albert Maldonado made the following announcements:
The City Council voted to settle item A(ii) Jeffrey Lamont Williams v. City of San
Bernardino in the amount of $199,999.00. The motion was made by Council Member
Sanchez and Seconded by Council Member Flores; approved 7-0.
At the direction of the Mayor and City Council, Deputy City Attorney responded to public
comments alleging conflicts of interest related to campaign contributions from the San
Bernardino Police Officers Association. He stated that under the Levine Act, no conflict
exists, as the Act does not apply to lawsuits, the City is not adverse to the union, and
union contributions are not covered; therefore, Council Members and the Mayor may
participate in closed session discussion of the Treasure Ortiz lawsuit.

Mayor Pro Tem Knaus and the City Council presented the certificates to the following

The Mayor and City Council presented the proclamation to Eddie Munoz, City of San
Bernardino Principal Engineer, and recognized all of the City Engineers.
3. Proclamation of Lunar New Year Day in the City of San Bernardino – February 21,
2026 (All Wards)
The Mayor and City Council presented the proclamation to Rasmey Sam of the Asian
American Resource Center and local businesses.

Recommendation:

representing Ward 1 with the term ending December 2026. Hector Loera will replace
Maria Lanas. Council Staff has verified that appointee is a registered voter within the
city.

Recommendation:

PUBLIC HEARING
7. Introduce for First Reading Ordinance No. MC-1660 Adopting a Regulatory
Program for Short Term Rentals, or Introduce for First Reading Ordinance
No. MC-1661 Banning Short Term Rentals in the City of San Bernardino (All
Wards)
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino:
a. Hold a Public Hearing; and
b. Introduce and read by title only, and waive further reading of Ordinance No. MC-
1660 of the Mayor and City Council of the City of San Bernardino, California,
adopting a regulatory program which would amend Section 19.02.050 (Basic
Provisions – Definitions) and Chapter 19.04 (Residential Zones) of the City of
San Bernardino Development Code (SBMC Title 19) for short-term and
vacation rentals in the City of San Bernardino; or
c. Introduce and read by title only, and waive further reading of Ordinance No. MC-
1661 of the Mayor and City Council of the City of San Bernardino,California
banning Short Term and Vacation Rentals in residential zones in the City of San
Bernardino; or
d. Take no action on the matter.
Mayor Tran opened the public hearing at 5:54 p.m., but returned to the appointments agenda item, to allow the City Clerk to administer the oath of office to the appointees.

Department Director of Community Development and Housing Gabriel Elliot provided a presentation to the Mayor and City Council.
At this time public comments for the public hearing were heard.
Les expressed support for allowing short-term rentals and suggested the City focus on addressing homelessness and other issues rather than regulating short-term rentals.
Joe Salas expressed support for regulating short-term rentals, noting that other cities generate significant tax revenue from them and suggesting that clear regulations and fines could help San Bernardino capture revenue while addressing neighborhood impacts.
Tyesha Moody opposed the proposed ban on short-term rentals, advocating instead for regulation that protects homeowners’ property rights while allowing permits, neighbor notification, and enforcement for violations.
The Mayor and City Council discussed short-term rentals, including potential revenue from Transient Occupancy Tax (TOT) and concerns regarding neighborhood impacts such as noise, parties, trash, and parking. Questions were raised regarding Code Enforcement staffing levels, current case volume, and the City’s capacity to monitor and enforce regulations. Staff explained that noise violations are not handled by Code Enforcement and discussed the potential use of a third-party vendor to identify and monitor short-term rental properties and assist with TOT collection, including possible agreements with rental platforms. Council Members also discussed enforcement challenges, potential staffing needs, and the possibility of using fees or revenue to support enforcement. Concerns were expressed regarding whether the City could effectively enforce regulations, while others noted that regulation or prohibition would still require oversight.
Assistant City Attorney Albert Maldonado clarified to the Mayor and City Council that substantive changes cannot be made at the second reading and adoption of the ordinance, recommending that if additional review or proposed revisions are needed, the public hearing be continued to a future meeting; otherwise, if the first reading proceeds, only non-substantive changes may be made, though amendments may be proposed after adoption.
Council Member Sanchez made a motion to continue the Public Hearing to the March 18,
2026, Regular Mayor and City Council Meeting to further study and review the
regulations. The Motion was Seconded by Mayor Pro Tem Knaus

CITY MANAGER UPDATE
The City Manager provided updates on upcoming infrastructure projects, including a
planned closure related to the Diverging Diamond Interchange project at the 215 and
University Parkway, noting dates may change due to weather. Additional announcements
included the City hosting a stage of the Great Race, completion of a new segment of the
Santa Ana River Trail, upcoming community events, a Public Works community workshop,
a Charter Review Commission meeting, and the Public Library’s spring book sale.

PUBLIC COMMENTS FOR ITEMS LISTED AND NOT LISTED ON THE AGENDA
Mike Hartley spoke in opposition to short-term rentals, expressing concern that one
enforcement officer would be insufficient and stating that enforcement would primarily fall
on the Police Department.
Al Palazzo spoke regarding Item 22, the Mount Vernon Specific Plan, and shared ideas
based on concepts he has observed while traveling.
Juan Ibarra spoke on behalf of residents in his neighborhood regarding drainage issues,
stating that water runs down their street during rainfall.
Christian Shaughnessy commented on Council Member Ibarra’s community engagement
and expressed concerns regarding special meetings.
Erick Marquez announced his candidacy for City Council Ward 4 and expressed criticism
of current leadership, also commenting on Item 19.
Philip Walls, representing the Small Business Administration, provided information
regarding disaster assistance loans available to residents who experienced property
damage from recent storms.
Les spoke in support of conducting a forensic audit of City finances from the bankruptcy
period to present and commented on actions of the Mayor and City Council.
Dolores Armstead expressed concerns regarding the use of taxpayer funds for special
meetings and questioned expenditures related to Item 9.
Sarah Robles referenced a submitted public record request and expressed concerns
regarding due process and statements related to CLETS access.
Virginia Marquez commented on a recent interview involving Council Member Sanchez
and encouraged accountability.
Ron Alvarado announced his candidacy for Ward 1 and discussed the importance of
collaboration with unions, workforce groups, and families.
James Smith highlighted positive developments in the City, acknowledged the Rotary
Club, and commended the City Manager.
Amy Malone, a Ward 4 resident, expressed concerns that short-term rentals were being
prioritized over other issues such as homelessness.
Tony Lara expressed concern for ongoing flooding issues on West 19th Street. He
requested relief and assistance in addressing the flooding problem requesting the
installation of storm drains.
The following speakers spoke in opposition to the Police Department’s Flock camera
system, citing concerns about privacy, community safety, immigration enforcement, and
requesting investment in community resources instead.

John Shollenberger called for an investigation into alleged city official misconduct and
raised concerns about accountability.
Scott Olsen thanked the City Council for appointing him to the Charter Review
Committee, expressing a commitment to actively address charter issues.
Sheheryar Kaoosji an Amazon employee commented on the use of technology and
employment opportunities and urged the City Council to review the Flock camera contract
over privacy and surveillance concerns.
Arthur Anderson expressed concerns regarding candidate accountability and called for
transparency from those running for office.
Lydia Savala stated she would like to continue conducting research, data analysis, and
presenting factual findings without fear of retaliation or harassment from other members
of the public.
Joe Salas addressed several council members regarding prior discussions and suggested
seeking legal guidance on certain matters.
Albert Duarte spoke in support of Council Member Ibarra’s proposal Item No. 20 and
expressed appreciation for the item being brought forward.
Caleb Reagan, representing Inland Empire labor unions, spoke in support of workforce
agreements and the potential for job creation.
Victor Suarez played recorded audio related to a conversation involving Council Member
Ortiz and a police sergeant.
At this time, a motion was made by Council Member Ortiz and seconded by Council
Member Sanchez to continue the meeting past 10:00 p.m., in accordance with Resolution
2024-029, and to take a five-minute recess. This was approved by a consensus of the
City Council.

9. Amendment No.1 to the Emergency Solutions Grant (ESG) Subrecipient
Agreements with The Salvation Army and Family Service Association of
Redlands
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California, adopt Resolution No. 2026-011:
1. Approving Amendment No. 1 to the FY 2025–26 Emergency Solutions Grant
(ESG) Program Subrecipient Agreement with The Salvation Army (TSA) to
increase the agreement by $74,276.38 incorporating prior-year unspent ESG
funds, revising the not to exceed amount to $241,535.38 and extend the
agreement term through December 31, 2026; and
2. Approving Amendment No. 1 to the FY 2025-26 ESG Program Subrecipient
Agreement with Family Service Association of Redlands to extend the
agreement term through December 31, 2026; and
3. Authorizing the City Manager, or designee, to take any additional actions and
execute any agreements or documents necessary to implement Amendment
No. 1 and administer the ESG grant program.
4. Authorizing the Director of Finance & Management Services to amend the FY

2025/26 operating and capital budget in the amount of $63,742.66 as a
technical correction to recognize unspent FY 23-24 ESG Funds.
Council Member Mario Flores pulled this item for questions. He asked for clarification
on the amendment.
Deputy Director of Community Development and Housing Cassandra Searcy
explained it extends contracts with Family Service Association of Redlands and the
Salvation Army through December 31, 2026, allowing additional time to expend ESG
funds and continue providing rapid rehousing, shelter, and homelessness prevention
services.

Purchase Agreement with Long Beach BMW Motorcycles, increasing the total

2. Authorize the Director of Finance and Management Services to increase the
existing purchase order from $77,218.00 to $158,622.84.

total Project budget to $455,560.00; and
3. Authorize the City Manager or designee to execute all documents with Estate
Design and Construction.; and

Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California authorize:
1. The City Manager to execute the following Goods Purchase Agreements
a. Fairview Ford for an amount not to exceed $1,197,825.32 for the
purchase of police fleet vehicles.
b. DuraTech USA for an amount not to exceed $255,000 for the purchase
of mobile data computers.
2. The City Manager to execute Goods Purchase Agreement Amendment No.
1 with Motorola Solutions increasing the total not to exceed amount by
$284,969.37 for a new total of $415,133.66 for the purchase of vehicle
radios; and
3. The City Manager to execute a Vendor Services Agreement with West Coast
Lights and Sirens for an amount not to exceed $2,500,000 for a term beginning
February 18, 2026, through June 30, 2030, for vehicle uplifting; and,
4. The Director of Finance and Management Services to issue purchase orders to
Fairview Ford for $1,197,825.32, West Coast Lights and Sirens for 750,000,
DuraTech USA for $255,000, and Motorola Solutions for $284,969.37.

17. Love Your Block Year 1 Update (All Wards)
Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California receive and file the Love Your Block 2024-2025 City Impact Presentation. Stephanie Castro Economic Development Project Manager provided a presentation highlighting the Love your Block project. Council Members expressed appreciation to staff for the successful completion of community art projects and collaboration with local artists and residents. The city was recognized as one of 16 nationwide to receive the grant. Staff highlighted upcoming opportunities related to Route 66’s 100th anniversary. The update concluded with recognition of staff contributions and anticipation of the next project round.

18. Adoption of Policy Establishing a Two-Step Authorization and Approval
Process for New and Renewal Leases of City-Owned Property (All Wards) Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California, adopt Resolution No. 2026-014, approving a standardized policy for city-
owned leases (new and renewals) that mandates City Council authorization before
negotiations begin and final approval before execution.
Michael Yarbrough Real Property Manager presented a resolution to establish a
standardized policy for new and renewed leases of city-owned properties, requiring
City Council authorization prior to beginning negotiations and final approval before
lease execution.
Council Member Sanchez expressed concern about allowing a six-month grace period
after lease expiration and recommended removing it to encourage proactive review
and renewal of leases before expiration.
Council Member Ortiz raised concerns that requiring council involvement before
negotiations could politicize the leasing process and create risks of favoritism or
interference with procurement practices.
Staff responded that lease agreements are often unique and early council direction
could help guide negotiations in certain cases.

66 Identity, Incorporate Robust Community Engagement, and Return to the City
Council with a Proposed Scope, Timeline, and Implementation Framework. –
