2. General Plan Amendment 25-03, Introduce Ordinance No. MC-1657
Adding Section 10.24.195 to the San Bernardino Municipal Code adopting
Citywide Truck Routes, and direct staff to comply with AB98 Warehouse
Design and Build Standards (All Wards)
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino:
1.Adopt Resolution No. 2025-393 of the Mayor and City Council of the
City of San Bernardino, California, adopting a Categorical
Exemption under the California Environmental Quality Act
Section 15301(c), and approving General Plan Amendment 25-
03 to amend the Circulation Element to add Citywide Truck Routes
Option A pursuant to Assembly Bill 98 (AB 98), (Attachment 1A).

2.Adopt Resolution No. 2025-394 of the Mayor and City Council of the
City of San Bernardino, California, adopting a Categorical
Exemption under the California Environmental Quality Act
Section 15301(c), and approving General Plan Amendment 25-

Mayor Tran opened the public hearing at 5:44 p.m.
Interim City Planner Saied Naaseh gave a presentation to the Mayor and City Council.
There were five Public Comments.
Dolores Armstead opposed designating major streets as truck routes, citing safety and
health concerns.

Mike Hartley spoke on the truck congestion from warehouse development and stressed
that traffic studies should come first to prevent worsening problems.
Al Palazzo opposed truck traffic on local streets, urging the City to prioritize housing and
transit-oriented development over more truck routes and warehouses.
Marvin Norman supported the truck route study but urged the City to address truck
parking and ensure trucks stay on suitable roads.
Luis Ojeda noted that trucks aren’t the main problem; poor planning, warehouse
approvals, and consumer demand for fast deliveries drive traffic issues.
Mayor Tran closed the Public Hearing at 6:09 p.m.
Council Members discussed the proposed truck routes and highlighted concerns about
truck routes through residential and historic areas. Locations identified included Mount
Vernon, Highland Avenue, Baseline, and Mill Street. Citing safety, traffic congestion, and
school zones. They emphasized aligning city truck routes with neighboring cities,
rerouting trucks from sensitive areas, and ensuring thorough public input. Staff confirmed
the map is not final and that adjustments will be made. Council requested a special
meeting to review the revisions, with final adoption expected at the regular meeting on
December 17, 2025.

PRESENTATIONS
1.San Bernardino International Airport Authority (SBIAA) Presentation (All Wards)
Chief Executive Officer Michael Burrows from the San Bernardino International Airport
gave the presentation to the Mayor and City Council.
At this time, the regular agenda was resumed.
CITY MANAGER UPDATE
City Manager Eric Levitt provided the City Manager Update. Highlights included Vanessa
Carder being named the new Director of Parks, Recreation, and Community Services,
Officer David Rosas retiring after 43 years of dedicated service, and California State
University San Bernardino continuing to provide a major economic impact, contributing
$1.2 billion annually and supporting 9,700 jobs. The City is offering $2.85 million in HUD
grant funding for community organizations, with applications due January 16, 2026.
Additionally, Thanksgiving for the animal shelter event served nearly 300 dogs, including a
pardoned turkey. The City kicks off the holiday season with events like the Downtown
Miracle on Court Street, the Ho-Ho Parade, and the YMCA Children’s Christmas Parade.
The City marked the 10th Anniversary of the Inland Regional Center attack, reaffirming the
“San Bernardino Strong” community message.
PUBLIC COMMENTS FOR ITEMS LISTED AND NOT LISTED ON THE AGENDA
Stephanie Tovar, Interim Program Director, San Bernardino YMCA, invited the
community to the YMCA's 48th annual Children’s Christmas Parade on December 13,
followed by a Jubilee with performances and community resources.
Al Palazzo praised San Bernardino’s arts, local businesses, and history, reflecting on
past tragedies and emphasizing the city’s resilience and potential for a better future.
Luis Ojeda praised the city beautification project and urged the council to respect public
time by starting meetings on schedule.
Christian Shaughnessy thanked the Council but criticized City policies that displaced
homeless youth for festival profits, urging urgent reform.
Delores Armstead thanked the council for a vote not to remove Commissioner Suarez
but criticized new home construction near contaminated sites, debris policies, the lack of
a city hall, and downtown development.
Mike Hartley spoke about the lack of Code Enforcement in the city, highlighting too few
traffic and parking officers, unpermitted ADUs, and code violations.
John Schollenberger addressed the special meeting, praised Council Members for their
integrity, and said he will continue speaking out despite feeling targeted.
Paige Miller urged stronger Code Enforcement, a ban on personal fireworks for safety,
and better leadership at the animal shelter, including proper spay/neuter programs.

Frederick Miller explained that he and others living at a homeless shelter at 450 North G
Street face eviction by January 1, despite a five-year lease and timely rent payments.
Lydia Fita-Sialoi urged the Mayor and City Council to oppose a ban on safe and sane
fireworks, noting that her church relies on fireworks fundraising to support a food bank
serving over 450 households each month.
Rene Mora, a resident of 450 North G Street, said seniors received short notices and
were offered money to leave and return to homelessness, and asked the City for help
finding a resolution.
Rebecca Alvarado, secretary of the First Samoan Assembly of God, urged the Council to
vote against banning safe-and-sane fireworks, explaining that fireworks sales are the
church’s primary source of funding.
Maelena Enriquez opposed motel blackout policies that displace young people for
festivals, urging the city to prioritize safety and human dignity over profit.
Jonathan Alvarado opposed the fireworks moratorium, saying church fireworks sales
support youth involvement and fund a food bank, and should not be blamed for illegal
fireworks.
John Kelly, a representative from TNT Fireworks, opposed the proposed fireworks
moratorium, arguing that bans do not stop illegal fireworks, that sales trends are being
misinterpreted, and that legal fireworks help fund public safety and support nonprofits.
Kenneth Alvarado urged no fireworks moratorium, saying sales fund church programs,
and police said it wouldn’t reduce illegal fireworks.
Bob Fredericks, a San Bernardino native, said the fireworks moratorium is unnecessary
and won’t reduce fires; education or a study could address concerns.
Sharon Negrete urged the city to address the animal shelter’s severe understaffing and
poor conditions.
Barbara Sky criticized the council for approving a tentative tract with incorrect dates and
excessive extensions, claiming it exceeded legal limits.
Ricardo Hernandez criticized the city for misleading information, inexperienced staff, and
the waste of taxpayer money on a flawed report on the 26-foot wall and tract map.
Stephanie Lenfestey expressed concerns about inadequate veterinary accountability and
post-surgical care, emphasizing the need for a full-time veterinarian.
Benitos Barrios thanked city leadership for supporting the Marine Corps League
celebration and voiced support for continuing safe-and-sane fireworks. He also raised
concerns about delays, costs, and accountability issues with the Navigation Center.

Prior to hearing the Consent Calendar, City Manager Levitt announced that staff would be
pulling Item No. 11 and Item No. 14, bringing them back to the December 17th meeting.
CONSENT CALENDAR
Items on the Consent Calendar are considered routine and are voted on in a single
motion unless a council or staff member has pulled the item for more discussion.
Prior to taking the Consent Calendar vote, Council Members Sanchez, Shorett, and
Mayor Tran, all recused themselves from Item No. 6 due to a Levine Act financial
conflict for receiving campaign contributions from San Manuel.

Recommendation:
It is recommended that the Mayor and City Council of the City of San
Bernardino adopt Resolution No. 2025-396, approving the Citywide Cost Allocation
Plan (CAP) and OMB Compliant Indirect Cost Plan prepared by Matrix Consulting
Group, based on the City’s Fiscal Year 2022/23 adopted budget, and authorizing
its use for the following purposes:

1.Recovering indirect costs associated with state and federal
grants, consistent with the requirements of 2 CFR Part 200; and

9.Authorize an Agreement with Forensiclean LLC for Crime Scene Clean Up

Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California,
1. Authorize the City Manager to execute a Professional Services
Agreement with Forensiclean LLC to provide crime scene clean up
services for a term beginning December 3, 2025, through June 30,
2028, with an option to extend for two additional years; and
2. Authorize total expenditures not to exceed $225,000, which includes
$135,000 for the initial term and up to $90,000 for the optional two-year
extension, if exercised by the City.
Council Member Ortiz pulled the item and asked that local vendor preference be
included in the RFP for crime scene cleanup services. Staff confirmed that a 5%
local preference was applied, and the local bidder still submitted one of the highest
bids.

10.Technical Correction for the Citizens’ Option for Public Safety Program
to Amend the Fiscal Year 2025/26 Operating Budget (All Wards)
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California, adopt Resolution No. 2025-397, authorizing the Director of Finance &
Management Services to amend the Fiscal Year 2025/26 Operating Budget to
increase grant funded expenditures by $204,240.27 to reflect funding available in
the Citizens’ Option for Public Safety Program.

Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California;
1.Approve the award of a Professional Design Services Agreement
with IDS Group, Inc. in the amount of $140,633 for the City Hall
Parking Structure (5 Level) Improvements Project; and
2.Authorize a contingency amount in total of $9,367 for the project,
bringing the total project budget to $150,000; and
3.Authorize the City Manager or designee to execute all documents
with IDS Group; and
4.Authorize the City Manager or designee to expend the
contingency fund, if necessary, to complete the project.

12.Accept Bridge Investment Program (BIP) Planning Grant for the
Bridge Rehabilitation Planning Project in the Amount of $676,348 (Wards 2, 4,
and 5)
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California:
1. Adopt Resolution No. 2025-398 accepting the Bridge Investment
Program (BIP) Planning Grant for the Bridge Rehabilitation Planning
Project in the amount of $676,348; and
2.Authorize the City Manager or designee to execute the grant agreement
and all related documents in the total project amount of $845,435; and
3. Authorize the Director of Finance & Management Services to amend the
FY 2025/2026 budget by recognizing $676,348 in federal grant revenue
and appropriating the same amount in project expenditures for the
Bridge Rehabilitation Planning Project; and
4. Authorize the Director of Finance & Management Services to appropriate
$169,087 from the Local Regional Circulation Fund to satisfy the
required 20% local match; and
5. Authorize the Director of Finance & Management Services to amend the
FY 2025/2026 Capital Improvements Program to add the Bridge
Rehabilitation Planning Project in the total amount of $845,435.

Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California:
1.Approve Amendment No. 1 to the Maintenance Services Agreement withWest Coast Arborists, Inc. to extend the term of the agreement from June30, 2025, to June 30, 2026; and to update the not-to-exceed amount to$6,134,604.90, in order to reflect total cumulative spending andanticipated needs for the full contract term, consistent with thecompensation provisions of the Original Agreement; and
2.Authorize the City Manager to execute all documents necessary to

increase the contract amount by the council approved one-time allocation of $500,000 for tree stump removals; and
3. Authorize the City Manager to execute all related documents necessary to
effectuate these amendments.
4.Authorize the Interim Director of Finance and Management Services toissue a purchase order for West Coast Arborists for $1,700,000.00 forfiscal year 2025-2026.
Council Member Ortiz pulled the item and discussed the tree maintenance contract costs, clarifying that approximately $1.2–$2.5 million per year covers a range of services including grid trimming, tree and stump removal, storm response, and palm tree maintenance. Staff explained the pricing, confirmed that a public trimming schedule can be provided, and stated that the city is receiving good value based on negotiated rates and industry standards.

amount not to exceed $300,000 for on-call geotechnical investigation

19.Adopt Resolution Approving Final Tract Map No. 16794 (Ward 5)
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California, adopt Resolution No. 2025-399, approving Final Tract Map No. 16794
(Subdivision 06-31) involving the subdivision of a parcel (APN 0261-011-08, 13,
and 14) containing 18.45 acres into forty-three (43) single family residential lots
and one (1) debris basin located on the west side of N. Palm Avenue,
approximately 200 feet north of W. Verdemont Drive within the residential low
(RL) zone, accepting the public dedications as set forth on said map; and
authorizing execution of the standard form of agreement for the subdivision
improvements.
Council Member Ortiz pulled the item for further discussion. She discussed the
subdivision map’s impending expiration and longstanding community concerns.
Director Elliott reported no environmental or project changes since the original approval,
so no new review was required.
Deputy City Attorney Maldonado stated the developer had vested rights and could not be
forced to restart without legal risk.
Council Member Knaus clarified that the Oxbow debris issue was separate and
highlighted the need for new housing and the developer’s positive track record.

DISCUSSION
21.Discussion for a Potential One-Year Moratorium on the Sale and Use of
Fireworks Within the City of San Bernardino and/or Additional Strategies to
Enhance the City’s Enforcement to Reduce the Use of Illegal Fireworks (All
Wards)
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California, discuss several options which include a social host ordinance and
drone enforcement program, a potential one-year moratorium on the sale and
use of fireworks, and/or maintaining the current safe and sane fireworks
ordinance with regulatory fee, and to provide direction to staff regarding the next
steps, if any.
Senior Management Analyst William Lampi gave a presentation to the Mayor and City
Council.
Council Member Sanchez made a motion to receive and file the report and direct
staff to look into a social host ordinance and drone enforcement program. Council
Member Knaus seconded the motion.
Council Member Ortiz made a substitute motion to approve staff’s recommendation.
Mayor Pro-Tem Figueroa seconded the motion. The motion failed 2-4 with Council
Members Sanchez, Shorett, Knaus, and Flores voting in opposition.

22.Status on the General Plan Update
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California, receive and file an update on the status of the General Plan Update
and provide additional direction to staff, as needed.
Director of Community Development and Housing, Gabriel Elliott, gave a presentation
to the Mayor and City Council.
Council Members expressed concern that the plan is outdated given changes in
community needs, emphasizing the importance of renewed public engagement,
coordination with advisory bodies, and transparency. Staff noted timeline constraints and
goals for returning to council by March 31st.

Amendment 25-10 (Accessory Dwelling Unit 2025 Legislative Update)
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino
adopt Urgency Ordinance No. MC-1658U of the Mayor and City Council of the
City of San Bernardino, California, approving Development Code Amendment 25-
10 amending Chapter 19.04 (Residential Zones); Section 19.04.030(2)(P)
(Residential Zones Specific Standards - Accessory Dwelling Units) of the City of
San Bernardino Development Code (SBMC Title 19) to update the
development standards for Accessory Dwelling Units and Junior Accessory
Dwelling Units in compliance with recent changes in state law;, and finding such
action statutorily exempt from the California Environmental Quality Act under
Public Resources Code Section 21080.1

It is recommended that the Mayor and City Council of the City of San Bernardino
California:
1.Receive and file the Pavement Management Program (PMP) draft
report update; and
2. Provide direction on neighborhood rehabilitation focused areas and
funding strategies; and
3.Direct staff to incorporate the PMP findings and recommendations into
the FY 2026–2036 Capital Improvement Program (CIP); and
4.Authorize staff to evaluate and pursue sustainable funding strategies,
including potential bond financing, Measure S allocations, and available
state and federal grant opportunities.

MAYOR & CITY COUNCIL UPDATES/REPORTS ON CONFERENCES & MEETINGS
At this time, the Mayor and City Council provided updates to the community. Highlights
included neighborhood beautification efforts, major capital improvements, upcoming
holiday events, volunteer activities, and regional meetings advocating for city priorities.
Mayor Pro Tem Figueroa and Council Member Ibarra attended the National League of
Cities and participated in solution sessions on topics including cleaner cities, downtown
revitalization, and livability. They also noted meeting with the city’s Washington, D.C.
lobbyist to discuss advocacy for additional funding for the city. The meeting concluded
with recognition of city staff and public safety personnel, community service efforts, and a
moment of remembrance honoring the victims of the December 2, 2015, terrorist attack.
