Presentation Item No. 1 was presented prior to Closed Session, and Presentations continued with Item No. 3 after Open Session reconvened. PRESENTATION 1. American Rescue Plan Act Check Presentation - Guadalupe Field (Ward 1) San Bernardino County Board Supervisor Joe Baca, Jr. presented a $1,000,000 check to the City for the revitalizing of Guadalupe Field. The funds were a portion of the American Rescue Plan Act Funds received by San Bernardino County. CLOSED SESSION PUBLIC COMMENT There were no public comments received for Closed Session. A second roll call was not conducted. Upon the resuming of Open Session, City Clerk Genoveva Rocha made an announcement regarding clerical errors on the meeting Agenda. She advised that the meeting was not a Special Meeting, as noted in the Agenda, but was in fact a Regular Meeting. In addition, Open Session was set at a time and place consistent with Regular Meetings, in accordance with Section 2.58.10 of the Municipal Code, rather than at a specified time. The meeting was noticed in compliance with the Brown Act, and all Public Hearings were also properly noticed. Regular Meeting Minutes June 15, 2022 Mayor and City Council of the City of San Bernardino Page 3 INVOCATION AND PLEDGE OF ALLEGIANCE Council Member Damon Alexander led the Invocation and Council Member Fred Shorett led the Pledge of Allegiance to the Flag. CLOSED SESSION REPORT City Attorney Sonia Carvalho stated that there was no reportable action from Closed Session. CITY MANAGER UPDATE City Manager Rob Field provided city-wide updates. Highlights included updates on events and projects across the city, code enforcement expanding hours, positive community feedback, and a multi-agency crime sweep that was conducted. A fireworks update was also provided, in light of the upcoming July 4th Holiday. MAYOR & CITY COUNCIL UPDATES/REPORTS ON CONFERENCES/MEETINGS At this time, the Mayor and City Council provided updates to the community. Highlights included the recent inaugural Downtown San Bernardino 5K Run, community meetings, Council Member re-elections, Juneteenth and 4th of July events, and welcoming new Police Chief Darren Goodman. PRESENTATIONS (Continued From Earlier Open Session) 2. Resolution for Dean McVay, Esq. President, Board of Directors SB Symphony Association (All Wards) Mayor Pro-Tem Figueroa read the Resolution, and the City Council presented the Certificate to incoming Symphony Board President Judith Valles, who accepted on behalf of outgoing President Dean McVay. President Valles thanked the City and the Community. 3. Proclamation for Juneteenth - June 2022 (All Wards) Mayor Pro-Tem Figueroa read the Proclamation. The City Council presented the Certificate to the San Bernardino Juneteenth committee. 4. Proclamation for National Parks & Recreation Month - July 2022 Mayor Pro-Tem Figueroa read the Proclamation. The City Council presented the Certificate to Parks and Recreation staff. Director Lydie Gutfeld thanked the council and staff. 5. Citizen of the Month - Johnny Cervin - June 2022 (Ward 7) Council Member Alexander presented the certificate to community member Johnny Cervin. Mr. Cervin thanked the council and the community. PUBLIC COMMENTS FOR ITEMS LISTED AND NOT LISTED ON THE AGENDA Treasure Ortiz commented on the recent election results. She also discussed the importance of the City Manager working with the community. John Shollenberger thanked Treasure Ortiz for bringing awareness to the community. Regular Meeting Minutes June 15, 2022 Mayor and City Council of the City of San Bernardino Page 4 Harry Hatch spoke about fireworks, and raised concerns about the amount of money the City spends on fireworks enforcement. Dolores Armstead advocated staffing assistance for the Council Members, asked for status of the old City Hall, and thanked everyone for voting in the recent election. Jim Penman congratulated the Council Members on the election and thanked the community for their support in his campaign for Mayor. Robert Porter spoke about how more voter outreach was needed to increase voter turnout. Christian Shaughnessy congratulated the Council Members and spoke about the need for better infrastructure in the city, voter turnout, and violence prevention programs. Ronald Donis spoke in opposition to Agenda Item No. 38. He also commented about a recent inquiry into the police department regarding racial bias. Sandra S. reminded all Council Members that their votes affect the entire City. She suggested rescheduling meetings rather than cancelling them due to holidays. Francisco Ramirez discussed his experience with parks and recreation. He suggested that more parent engagement be promoted in the City, like other local cities. Frank Perez spoke about his organization “Rewritten”, and their recent 5K event. At this time, the following remote speaker was heard via Zoom: James Albert provided statistics on low voter turnout and suggested that the City utilize Ranked-Choice Voting in the future. DISCUSSION 6. Designation of Voting Delegates and Alternates - 2022 League of California Cities Annual Conference & Expo September 7-9, 2022 (All Wards) Recommendation It is recommended that the Mayor and City Council of the City of San Bernardino, California, approve the selection of one voting delegate and two alternate voting delegates to the 2022 League of California Cities Annual Conference & Expo on September 7-9, 2022 in Long Beach, California. Council Member Sanchez nominated Council Member Calvin as the voting delegate, and Council Members Shorett and Alexander as the alternates. Ethics Training for All City Employees (All Wards) Recommendation It is recommended that the Mayor and City Council of the City of San Bernardino, California, discuss and provide direction on the establishment of ethics training for all City of San Bernardino employees. Staff recommends expanding the requirement of AB 1234 training to all employees required to file under the City's Conflict of Interest Code and utilizing online training available through Vector Solutions for all other employees. Human Resources Director Rene Anderson provided a presentation. She explained how the ethics training would be provided and monitored. She advised that City culture and environment are equally as important to ethics as training requirements. Council Members discussed the benefits of the training for all staff compared to the low cost of training. Council Member Sanchez made a motion to adopt staff’s recommendation. The motion was seconded by Council Member Alexander Council Member Shorett said that he did not agree with introducing the requirement for all staff members. He also stated that it is incumbent upon the leaders and management of the city to create an ethical culture and high standards. Development Code Amendment 22-01 (Home Occupational Permits) (All Wards) Recommendation It is recommended that the Mayor and City Council of the City of San Bernardino, California: 1. Introduce, read by title only, and waive further reading of Ordinance No. MC-1583 of the Mayor and City Council of the City of San Bernardino, Regular Meeting Minutes June 15, 2022 Mayor and City Council of the City of San Bernardino Page 6 California, approving Development Code Amendment 22-01 amending Section 19.54.030 (Operating Standards) of the City of San Bernardino Municipal Code (Title 19) updating the standards for home occupations; and finding the Ordinance is exempt under the California Environmental Quality Act (Attachment 1); and 2. Schedule the adoption of the above Ordinance for the regularly scheduled meeting of the Mayor and City Council on July 20, 2022. Mayor Pro-Tem Figueroa opened the public hearing at 8:55 p.m. Planning Division Manager Oliver Mujica gave a presentation to the City Council. He advised that the Planning Commission unanimously recommended this item for approval. There were no public speakers or requests to speak. Mayor Pro-Tem Figueroa closed the Public Hearing at 8:59 p.m. Mayor Pro Tem Figueroa asked if this action would affect people who work remotely from home. Manager Mujica confirmed that this is only geared toward self-employed individuals and/or home businesses. RESULT: APPROVED STAFF’S RECOMMENDATION; INTRODUCED ORDINANCE NO. Request to Amend Commercial Cannabis Business Permit CCB 18-0021 (Ashe Society – 590 S. E Street) to Provide a Change in Location (Ward 1) Recommendation It is recommended that the Mayor and City Council of the City of San Bernardino, California approve the Commercial Cannabis Business Permit (CCB) 22-0001, Change of Location for Ashe Society SB, LLC from 590 S. E Street to 444 N. H Street. Mayor Pro-Tem Figueroa opened the public hearing at 9:00 PM. Economic Development Specialist Stephanie Sanchez provided background information on the item. There were no public comments or requests to speak. Mayor Pro-Tem Figueroa closed the public hearing at 9:03 PM. Regular Meeting Minutes June 15, 2022 Mayor and City Council of the City of San Bernardino Page 7 Council Members inquired as to why the business wanted to change their location. Stephanie Sanchez advised that their original location was no longer conducive to a retail environment. City Attorney Carvalho further explained that after the settlement agreement process related to the cannabis business license permits was complete, the original location was no longer available. This move was beyond the control of the operator. The applicant’s attorney (name unintelligible) reiterated that the location was limited to a specific zone, property availability, and building size. Council Member Ibarra left the dais prior to the vote taking place. Public Hearing for Draft Annual Action Plan (All Wards) Recommendation It is recommended that the Mayor and City Council of the City of San Bernardino, California, conduct public hearing No. 1 on the review of the draft Fiscal Year 2022- 2023 Annual Action Plan (AAP) associated with the Community Development Block Grant, HOME Investment Partnerships and Emergency Solutions Grant Programs. Council Member Ibarra returned to the dais during the discussion of this item. Mayor Pro-Tem Figueroa opened the public hearing at 9:15 p.m. Director of Finance Barbara Whitehorn provided a report on the Annual Action Plan associated with the Community Development Block Grant (CDBG) , HOME Investment Partnerships and Emergency Solutions Grant Programs. She noted that the process had been delayed due to issues with the Department of Housing and Urban Development (HUD). Council Member Sanchez asked about the CDBG allocation for street re-pavement and asked for details about how the streets were chosen. Alex Qishta from Public Works advised that the re-pavement projects were determined by the “remaining life” of the streets within certain Census Tracts, per CDBG regulations. Council Member Calvin asked if these funds could be used for parks, and/or for community-based organizations (CBOs). City Manager Field stated that these funds were to be used only for the purposes stated in the report, due to restrictions imposed by CDBG. There were no public speakers or requests to speak. Resolution Confirming Assessments for Unpaid Solid Waste Collection Services (All Wards) Recommendation It is recommended that the Mayor and City Council of the City of San Bernardino, California: 1. Hold a Public Hearing; and 2. Adopt Resolution No. 2022-111 of the Mayor and City Council of the City of San Bernardino, California, making determinations and confirming assessments and proceedings for unpaid solid waste collection services. Mayor Pro-Tem Figueroa opened the public hearing at 9:33 p.m. Director of Public Works Daniel Hernandez provided a presentation to the City Council. He advised that property owners have until August 19th to make a payment to remove their lien. City Attorney Sonia Carvalho clarified that the public hearing was solely related to unpaid solid waste bills. City Clerk Rocha announced that the City Council had been provided with an updated exhibit for this item, and the revised exhibit was also available on the City’s website and in person at the meeting. There were no public speakers or requests to speak. Mayor Pro-Tem Figueroa closed the public hearing at 9:37 p.m. Council Member Sanchez advised the public that paying a delinquent assessment will remove any liens on property. Mayor Pro-Tem Figueroa asked staff how often this list was brought forward, and why there was such a difference in the dollar amounts of the liens. Director of Public Works Daniel Hernandez and City Attorney advised that the originator of the solid waste account typically receives the bills, therefore some liens may be higher due to the recipient having multiple properties. Council Member Alexander asked if the past-due notices were sent to owners and tenants. Mike Arreguin with Burrtec Industries stated that property owners are ultimately responsible for the assessments, since solid waste service is mandatory for each property in the City. Adopt Resolution No. 2022-112 of the Mayor and City Council of the City of San Bernardino, California, calling an election to submit to the qualified electors the question of levying a special tax within the area proposed to be annexed to Community Facilities District No. 2019-1 (Maintenance Services) (Annexation No. 15); 3. Hold a special landowner election and canvass the election; 4. Adopt Resolution No. 2022-113 of the Mayor and City Council of the City of San Bernardino, California, declaring election results for Community Facilities District No. 2019-1 (Maintenance Services) (Annexation No. 15); 5.
