D) PUBLIC EMPLOYEE EVALUATION (Pursuant to Government Code Section 54957 (b)(1)): City Manager 7:00 PM INVOCATION AND PLEDGE OF ALLEGIANCE Pastor Greg McNair from All Nations Church led the Invocation and Mayor Pro Tem Juan Figueroa led the Pledge of Allegiance to the Flag. CLOSED SESSION REPORT City Attorney Sonia Carvalho stated that there was no reportable action from Closed Session. CITY MANAGER UPDATE At this time, City Manager Rob Field provided city-wide update, including Code Enforcement property abatements, small business grants, and Red Ribbon Week. MAYOR & CITY COUNCIL UPDATES/REPORTS ON CONFERENCES/MEETINGS At this time, the Mayor and City Council provided updates to the community. Highlights included neighborhood cleanups, truck route study commencing, the General Election next week, and the upcoming Miracle on Court Street holiday events. Community Member Recognition: Edwin Johnson, Chords Enrichment Program for Festival Mayor Valdivia presented a certificate to Edwin Johnson. PUBLIC COMMENTS FOR ITEMS LISTED AND NOT LISTED ON THE AGENDA John Hillman spoke about the need to advertise San Bernardino’s potential as a city and his displeasure with an agreement with the American Civil Liberties Union (ACLU) on how to handle homeless individuals. Steve Mitchell spoke about trucking and homelessness. Lisa Lamb shared upcoming activities and events at the Norton Science & Language Academy. Thelma Thomas spoke about addressing homelessness and issues with trucking. Douglas Houser spoke about gun control and stated that citizens had the right to bear arms. Janice Houser spoke against the gun ban resolution. Celeste Williams spoke about issues in her neighborhood with the rising number of homeless individuals. Jim Penman spoke about the agreement with the ACLU and the need to address the homelessness issue. Thomas Ruiz spoke about the Carousel Mall demolition and asked for environmental remediation after its demolition. Robert Porter encouraged everyone to vote and discussed recent events in the community. Les Phillip asked for notification about businesses coming into the community. Monica Robles spoke about the Asociacion de Emprendadores and thanked the Council for their support. Christian Flores spoke, via Zoom, about the Carousel Mall demolition and the need to have an environmental analysis. DISCUSSION 2. Award Design/Build Contract for the Carousel Mall Demolition (Ward 1) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California: Regular Meeting Minutes November 2, 2022 Mayor and City Council of the City of San Bernardino Page 4 1. Determine approval of the Design/Build Contract is statutorily exempt from environmental review pursuant to Sections 15268 and 15269 of the State’s guidelines implementing the California Environmental Quality Act; and 2. Approve an award of a Design/Build Contract with Resource Environmental, Inc. in the amount of $7,734,000 adding an allowance in the amount of $2,266,000, for a total amount of $10,000,000; and 3. Authorize the Agency Director of Administrative Services to amend the FY2022/24 CIP to include Carousel Mall Demolition Project (“Project”) in the total project cost amount of $10,000,000; and 4. Authorize the City Manager or designee to execute all documents related to the Project. Daniel Hernandez provided a report on the contract for the Carousel Mall demolition. There was discussion amongst the Mayor and City Council regarding the cost of demolition, the timeframe, and environmental impacts. Council Members requested clarification on contingencies and comparison of bids. Council Member Calvin made a motion to bring the item back at a future meeting, once reports on the environmental impacts were complete and available. Council Member Reynoso seconded the motion. Council Member Sanchez made a substitute motion to direct staff to review all proposals received, and to bring back the item on December 7, 2022. If the recommendation remains the same, staff shall ensure that Resource Environmental, Inc., be held to the contract of $7,734,000 with no change orders. Council Member Calvin stated that the environmental reports were still needed. City Manager Robert Field stated that the report would be brought back with the Phase 1 reports and all bids. Council Member Shorett asked for confirmation that any problems below the surface would be dealt with later. Daniel Hernandez confirmed that this was the case. Approval of the Draft Fiscal Year 2021­2022 Consolidated Annual Performance and Evaluation Report (CAPER) to the US Department of Housing and Urban Development Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, conduct a public hearing on the draft Fiscal Year 2021-2022 Consolidated Annual Performance and Evaluation Report and authorize its submission to the United States Department of Housing and Urban Development (HUD). Mayor Valdivia opened the public hearing at 10:27 p.m. Deputy Director of Housing and Homelessness Cassandra Searcy gave a presentation to the City Council and gave an overview of the CAPER. There were no public speakers or requests to speak. Mayor Valdivia closed the Public Hearing at 10:32 p.m. (Council Member Shorett left the dais at 10:29 p.m. and was not present for the vote on this item). Community Facilities District No. 2021­1 (Ferree Street) 2022 Special Tax Bonds (Ward 3) Recommendation: Adopt Resolution No. 2022-225 of the Mayor and City Council of the City of San Bernardino, California, authorizing the issuance of, not to exceed $4,000,000, aggregate principal account of Community Facilities District No. 2021-1 (Ferree Street) of the City of San Bernardino Special Tax Bonds, Series 2022; approving a form of preliminary official statement, a form of the fiscal agent agreement, a form of bond purchase agreement, and a form of continuing disclosure agreement; making certain determinations relating thereto; and authorizing certain other action in connect therewith. Property Tax Exchange Agreement for the Annexation of Mountain View Avenue Bridge into the City of San Bernardino and detachment from the City of Redlands Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California, Adopt Resolution No. 2022-224 of the Mayor and City Council of the City of San Bernardino, California, determining there will be no property tax revenues to be exchanged between the City of San Bernardino, the City of Redlands, and the San Bernardino County Fire Protection District resulting from the jurisdictional change described by LAFCO case number 3258 for portions of real property of approximately 6.27 acres in total area located at the Mountain View Avenue Bridge (portions of APN 0292-011-37-0000, APN 0292-011-42- 0000, and portion of the road bridge) (Attachment 1).
