INVOCATION AND PLEDGE OF ALLEGIANCE San Bernardino Police Department’s Chaplain Nelson Glass led the Invocation. Barton Elementary School ASB President Aaron Caballero led the Pledge of Allegiance to the Flag. CLOSED SESSION REPORT City Attorney Sonia Carvalho provided a statement regarding Item B (Public Employee Appointment) and Item C (Conference with Labor Negotiators) on the Closed Session agenda. She stated that the City engaged a professional consultant to assist with the City Manager search and selection process. There were 67 applications received and provided to the Mayor and City Council for review. From the 67, the Council agreed to interview five candidates. Possible terms of employment were offered to two applicants. A formal offer of employment has been made to a candidate. The employment agreement for the City Manager position will be on the October 4, 2023, Regular Regular Meeting Minutes September 6, 2023 Mayor and City Council of the City of San Bernardino Page 3 Meeting agenda in accordance with state law. This statement was unanimously approved by the Mayor and City Council. PRESENTATIONS 1. Proclamation for National Library Card Sign­Up & Literacy Month in the City of San Bernardino – September 2023 (All Wards) The Mayor presented the proclamation to James Pierson and Randy Clyde of the Library Board. Prior to Public Comments, Mayor Tran made an announcement that the City Council would be pulling Item No. 20 (Strategic Initiatives), due to the amount of time it would take to make the presentation and discuss the item. Council Member Reynoso made a motion to continue the item to a Special Meeting on Tuesday, September 12th at 5:30 p.m. The motion was seconded by Mayor Pro Tem Shorett and received unanimous support. PUBLIC COMMENTS FOR ITEMS LISTED AND NOT LISTED ON THE AGENDA Mayor Tran announced that due to the fact that there were 56 speaker slips, she would limit public comments to one minute and thirty seconds, in accordance with Resolution No. 2018-89. Val Christensen invited everyone to the re-opening of his restaurant, “Sundowners”. Leanna Uribe, field representative for Supervisor Joe Baca Jr., invited the community to the Del Rosa Fire Station groundbreaking ceremony. She also stated that a community townhall will be held regarding Fire Station #227. The following individuals spoke regarding Item No. 19 (Regular Ordinance Amending, or Repealing, Crime Free Housing Ordinance No. MC-1351). They believe the Ordinance should be repealed: “Prophet Dominic” stated that the City should build an amusement park or roller rink in the City, instead of big corporate developments. Rikke Van Johnson expressed support for the Interim City Manager regarding Item No. 20. Marsha Dougherty asked for support for the homeless population in the City. Albert Hopkins stated that he supports Interim City Manager McNeely. Al Palazzo said that he recommends the Lewis Group Companies to rebuild the Carousel Mall property. He also said that he has a lot of good ideas to help move the City forward. Regular Meeting Minutes September 6, 2023 Mayor and City Council of the City of San Bernardino Page 4 Frank Montes invited everyone to the Hispanic Coalition of Small Businesses upcoming awards ceremony. Stan Futch, President of Westside Action Group, expressed support for Item No. 20. Brett Ward commended the City Clerk for assisting him. He also expressed support for Item. No. 20. He supports aid for the homeless. Terry Boykins, Executive Director of Project Fighting Chance, spoke about his boxing program and introduced some youth boxers. James Smith from Native Sons of the Golden West applauded the police department and the article about them in the Sun Newspaper. He also stated that he recently had a good experience at the San Bernardino DMV (Department of Motor Vehicles). At 8:01 p.m., Mayor Tran paused public comments and re-ordered the agenda to ensure that the Public Hearings, Item No. 22 and Item No. 23, were heard at their published times. PUBLIC HEARING 22. Conduct Public Hearing and Introduction of an Ordinance to Grant a Franchise to Southern California Gas Company (All Wards) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California, take the following actions: 1. Find that the proposed ordinance is not a project subject to California Environmental Quality Act (CEQA) in accordance with Section 21065 of CEQA and State CEQA Guidelines Sections 15060 (c)(2), 15060 (c)(3), and 15378 and that the proposed action is exempt from CEQA pursuant to State CEQA Guidelines Section 15061 (b)(3); and 2. Conduct a public hearing to receive comments on the proposed franchise agreement with Southern California Gas Company. 3. Introduce, read by title only, and waive further reading of Ordinance No. MC-1621 to grant a franchise to Southern California Edison Gas Company. Prior to the Public Hearing, Staff provided a memo to the Mayor and City Council on behalf of the City Manager and Public Works Director correcting the recommendation and executive summary in the staff report for this item. The staff report mentioned Southern California Edison, but it should have said Southern California Gas Company “So Cal Gas”. Southern California Edison is not a part of this agreement. Mayor Tran opened the public hearing at 8:01 p.m. A presentation was provided by Agency Director of Public Works, Daniel Hernandez. There were two public speakers for this hearing: “Less” spoke in opposition to the franchise agreement. Regular Meeting Minutes September 6, 2023 Mayor and City Council of the City of San Bernardino Page 5 Cheryl Brown acknowledged the typo in the staff report and thanked staff for the correction. The public hearing was closed at 8:04 p.m. Council Members inquired as to whether the term of the agreement could be shortened. Director Hernandez stated that since there are no other natural gas providers in Southern California, the agreement would likely just come back again in 10 years. Robert Visconti with So Cal Gas stated that 20 years is the shortest franchise agreement they have entered into. Most Southern California cities have indeterminate agreements. He also said that the gas pipes in the City are owned by So Cal Gas, so they would have to be replaced if the City ended their agreement with So Cal. Continuation, to January 17, 2024, of Public Hearing Regarding Solid Waste Rate Increases and Resolution Adopting Rates for Solid Waste Services, Approving Third Amendment to the City’s Exclusive Franchise Agreement for Integrated Solid Waste Collection, Processing and Disposal Services with Burrtec Waste Industries, Inc., and Finding the Action Exempt from the California Environmental Quality Act. Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California approve the continuation of the Proposition 218 Public Hearing to receive comments on the proposed rate increases and Third Amendment to the City’s Exclusive Franchise Agreement for Integrated Solid Waste Collection, Processing and Disposal Services with Burrtec Waste Industries, Inc. (“Burrtec”) to the January 17, 2024, Mayor and City Council Meeting. Mayor Tran opened the public hearing at 8:15 p.m. The City Council chose not to hear staff’s presentation. There were no public speakers for this hearing. City Attorney Carvalho clarified to the Mayor and City Council that the Public Hearing was being continued, rather than closed, so that it did not have to be re-noticed. Director Hernandez stated that the Burrtec rate analysis and discussion would be brought before the Mayor and City Council in December 2023, prior to the Public Hearing. The following additional individuals spoke regarding Item No. 19 (Regular Ordinance Amending, or Repealing, Crime Free Housing Ordinance No. MC-1351). They believe the Ordinance should be repealed: Luis Ojeda asked that the Mayor and City Council hire the next City Manager based on his or her merit. Dolores Armstead spoke in opposition to the hiring of the new City Manager. She also spoke against the “big rigs” parking on Mt. Vernon and Route 66. Robert Porter encouraged everyone to register for the “Turkey Trot” marathon in November. He also encouraged people to decorate their homes for Halloween. Gina Mirelez asked for permission to reserve the Council Chambers for a Mexican Holiday on September 16th. “Less” thanked Parks and Recreation for their work. He also spoke in opposition to Council Members Figueroa, Ibarra, and Sanchez. Cheryl Brown spoke in support of Interim City Manager Charles McNeely and asked for more City streets to be repaved. Alcosaur Sumney asked for support for funding for cultural development. Andy Lara spoke in opposition to the Council Members receiving benefits and car allowances if they do not attend all Council meetings. R. Kodjoe Sumney commented in support of a training facility and technical school for young men coming to the Country. Georgia Lykouretzos commented in favor of spaying and neutering animals, as well as terminating unwanted animal pregnancies. Jim Penman asked that everyone attend the “Rendezvous Back to Route 66” on October 7th. At this time, City Clerk Rocha read the following comment into the record, per requested ADA accommodation: Hardy Brown expressed support for Interim City Manager McNeely’s plans for the City. CITY MANAGER UPDATE Jeff Kraus, Public Information Officer, provided city-wide updates including homeless outreach team successes, new development, an upcoming San Bernardino Symphony performance, and 9/11 remembrance events throughout the City. CONSENT CALENDAR Items on the Consent Calendar are considered routine and are voted on in a single motion unless a council or staff member has pulled the item for more discussion. Adopt Resolution No. 2023-137 calling for the holding of a Primary Municipal Election to be held on Tuesday March 5, 2024, for the election of certain officers as required by the provisions of the San Bernardino City Charter; 2. Adopt Resolution No. 2023-138 Requesting the Board of Supervisors of the County of San Bernardino consolidate a Primary Municipal Election to be held on March 5, 2024, with the Statewide Primary Election to be held on the date pursuant to 10403 of the Elections Code; 3. The candidate must provide two supporting proof of residency documents from subsections A through D and may only provide one support document per subsection (A-D). 2. Adopt Resolution No. 2023-142 Approving the Recognized Obligation Payment Schedule (ROPS) 24-25 A and B; and 2. Authorize the City Manager, as the Successor Agency’s Executive Director or designee, to: a. Transmit the ROPS 24-25 A and B to the State Department of Finance and other designated agencies as prescribed by the California Health and Safety Code (HSC); b. Side Letter Agreements with Bargaining Groups Regarding Premium Pay for City and Water Department Employees Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California, adopt Resolution No. 2023-143, authorizing the City Manager to execute side letter agreements with the City’s bargaining groups regarding premium pay. Regular Meeting Minutes September 6, 2023 Mayor and City Council of the City of San Bernardino Page 12 Council Member Sanchez requested that Resolution No. 2023-143 be amended to adjust the premium pay for part-time staff from $2,500 to $5,000. This would make the premium pay $5,000 for all employees, including the Water Department. Director of Finance Barbara Whitehorn confirmed that the additional amount would keep the premium pay under the budget previously approved by the Mayor and City Council. City of San Bernardino, et al., San Bernardino Superior Court Case No. CIVSB2100620, increasing the not to exceed amount to $350,000. Regular Ordinance Amending, or Repealing, Crime Free Housing Ordinance No. MC­1351 Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California 1. Introduce, read by title only, and waive further reading of Ordinance No. MC-1619 – An Ordinance of the Mayor and City Council of the City of San Bernardino, California, amending Chapter 15.27 of Title 15 of the San Bernardino Municipal Code regarding rental housing program maintenance standards; or 2. Introduce, read by title only, and waive further reading of Ordinance No. MC-1620 -- An Ordinance of the Mayor and City Council of the City of San Bernardino, California, repealing Chapter 15.27 of Title 15 of the San Bernardino Municipal Code (Crime- Free Rental Housing Program). Interim Community and Economic Development Director Mary Lanier provided a presentation. She stated that staff recommends adopting Option 1, introducing Ordinance No. MC-1619. There was discussion amongst the Mayor and City Council about which ordinance amended the program, and which ordinance repealed the program. Staff confirmed that if needed, an administrative correction will be made to execute the correct ordinance as approved by the Mayor and City Council. Council Member Reynoso made a motion to approve staff recommendation No. 2, repealing the Crime-Free Rental Housing Program. This was seconded by Council Member Calvin. Council Member Shorett made a substitute motion to approve staff recommendation No. 1, amending the Crime-Free Rental Housing Program. This was seconded by Council Member Ibarra. Adopt Resolution No. 2023-144: Regular Meeting Minutes September 6, 2023 Mayor and City Council of the City of San Bernardino Page 15 a. Approving and authorizing the Agency Director of Administrative Services to amend the City of San Bernardino’s FY 2023/24 Operating Budget totaling $5,705,188 with $3,435,188 in General Fund Strategic Reserve appropriations, $1,700,000 in General Fund Capital Contingency Reserve appropriations, and $570,000 in Cultural Development Fund appropriations; and b. Approving the creation of the Economic Development Department; and c. Directing staff to prepare and bring back a revised City salary schedule to include any new positions that are budgeted. 2. Approve the Proposed Strategic Initiatives for Future Years to be considered as part of the FY 2024/25 & FY 2025/26 Biennial Budget process and prioritize the Strategic Initiatives for funding. 3. Direct staff to bring back Strategic Initiatives that require further Council review and approval. Mount Vernon Avenue Viaduct ­ Amendment No. 3 to Cooperative Agreement No. 16­ 1001477 (Ward 1) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California, adopt Resolution No. 2023-145 authorizing the City Manager to execute Amendment No. 3 to Cooperative Agreement No. 16 -1 001477 with the San Bernardino County Transportation Authority (SBCTA) for the Environmental Clearance, Preliminary Design, Right-of-Way, and Design-Build Phases for the Mount Vernon Avenue Viaduct Project (Project), to increase the funding by an estimated amount of $13,331,534, to address the project extension and costs escalation during the Design-Build phase for a total Project cost of $244,811,419. Director Hernandez provided a brief introduction and introduced SBCTA and TransTech staff members to discuss the project. There was discussion amongst the Mayor and City Council regarding deadlines, delays, and funding sources.
