3. Quasi-Judicial Public Hearing – Sunshine Motel Red Tag Appeal
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino,
California adopt Resolution No. 2026-095 denying the appeal of the Red Tag
Closure Notice and Red Tag Correction Notice issued for 570 North H Street,
commonly known as Sunshine Motel, and affirming the Building and Safety
Division’s determination and orders.
Mayor Tran opened the Quasi-Judicial Public Hearing at 5:26 p.m.
City Clerk Telicia Lopez swore in the speakers.
In accordance with the requirements of a Quasi-Judicial hearing, the appellant and
staff were given 15 minutes to speak and a five-minute rebuttal.
Best Best & Krieger Attorney, Denise Hansen, Building Inspector Elias Rebollar, and
Building Official Jeremias Arellano presented to the Mayor and City Council. They
discussed the appeal of the red tag closure and correction notices issued for the
Sunshine Motel located at 570 North H Street. The Building and Safety Division reported
that the inspection identified extensive unpermitted electrical work and construction,
missing smoke alarms, and blocked emergency exits, creating unsafe conditions. Staff
also clarified that the County Fire Department’s annual inspections did not include
inspections for unpermitted construction or electrical work.
The Mayor and City Council discussed the distinction between the red tag appeal and
the separate motel operator permit revocation process related to alleged prostitution and
human trafficking. Staff explained that the search warrant allowed Code Enforcement
and Building and Safety staff to inspect the property for code violations and that the red
tag appeal before the Council was limited to building and safety issues.
Mayor Tran requested that staff return with an update on the implementation of an
ordinance, with a report requested by the second Council meeting in September.
The Mayor and Council also discussed enforcement of the red tag, including restrictions
on entering the property, potential penalties for unauthorized entry, and monitoring by
Code Enforcement and Building and Safety. Staff reported that an application for the
unpermitted office addition had been submitted and was under review.
Regular Meeting Minutes July 15, 2026
Mayor and City Council of the City of San Bernardino Page 5
Attorney Frank Wiser and Property Operator Jamie Bird, representatives of the
appellant, presented to the Mayor and City Council. Attorney Wiser argued that the red
tag proceedings involved constitutional and due process concerns and questioned
whether the City’s inspection was properly conducted. The motel operator testified that
he had not received prior code violation notices or been informed that the property posed
a safety concern. The property owners’ son stated that they intended to take over the
operation, make the necessary corrections, and had already submitted a permit
application for the office addition.
There were no public comments.
The Mayor and Council discussed the appellant’s concerns regarding the search warrant
and alleged pretextual use of Code Enforcement in conjunction with law enforcement.
Council also questioned the property’s recurring fire and safety violations, including
missing or inoperable smoke detectors, electrical conditions, and emergency egress.
The County Fire representative confirmed that the property had received fire-code
violations annually since 2022, while noting that previously cited violations had been
corrected. Building Official Arellano explained that the red tag was issued due to
significant building and safety violations that posed potential life-safety concerns.
Deputy City Attorney Maldonado stated that the search warrant authorized Code
Enforcement to inspect for City Code violations and that the administrative inspection-
warrant process under Code of Civil Procedure Section 1822.50 was an alternative
procedure.
The public hearing was closed at 7:09 p.m.

Council Members discussed the proposed development and its potential impact on
the Crestline Soaring Society’s hang-gliding operations. The developer remained
